I think you're going to find a wide range of answers to this, ayrissa. There are just so many variables that go into sentencing. Maybe someone can at least give you some general idea, though. I know that sometimes any information is better than no information. Your husband's lawyer will be able to give you a much better idea of what kind of time he's actually looking at though, since he has all the facts of the case.

my husband got 15 yrs @ 85% for robbery. hes doing time for everyone and there was so much that determined his time. he took it all the way to trial and went from 55yrs all the way down to 15yrs. it just all depends on the statistics, facts, where youre at.

Well he didnt take complete blame. We are trying to get him out on bail so he can bring up community service and find a job to show the judge that he isnt just some thug or something.
Im kinda excited about him coming out(hopefully)

well i wish you all the best. they did after 16 months in let my husband out on bail and he fought it. they others that were involved were his so called friends. one got away and the other took a plea, pointed the finger at my man and got probation. the sad part is they didnt even have real proof that it was my man who did the robbery on camera on nothing. he didnt have any violence on his record and had 1 prior non-violent before this. there was so much involved but he got the best deal he could get. good luck to you and your man and hopefully it all goes well.

My hubby got a 12 flat which means he's home in 6 with good time and up for parole in 4, but his charge was 1st degree. It really depends on the state he's in and the circumstances of the crime.

My son was just sentenced to a MINIMUM of 12 years for armed robbery, he was there but did not actually carry out the robbery, he and his friend, who also got 12 yrs, remained in the jeep the whole time. The kid that committed the acts received 18yrs.

Comparing State to State sentencing this Minimum Sentencing is OUTRAGEOUS, especially for a first time offender.

Watch out if you are in GA, especially Cobb County. It's not about punishment, it's about revenge. What a price to pay for being young, stupid and succumbing to peer pressureund... and not knowing the law! BEWARE!!

Hi Ayrissaoyola,
Yes, there is going to be a wide range of answers to this question :-(
Does he have a previous criminal record? will he be sentenced by the same judge?
and the state, these are just 3 factors!
my son received 60 years! let me break it down for you,
robbery 15 years (max.)
use of a deadly weapon (he had a gun, did not use it, but, just the same he had it) ~ Enhancement (mandatory time, no breaks!) 15 years
times 2 = 60 years
I would check with your state, find out what the minimum and maximum sentences are for his charges.
also, anyone else who has already been charged, in your state. (their sentence)
take into consideration, the 3 questions above. also, he could also take a plea!
a wide range of answers, sorry :-(
I know this is a difficult time for you both, have faith, be positive and supportive.
If I can help, please feel free to PM me.
god bless you both, your added to my prayer list :-)
Lynn

my husband got a flat 7, which means he has to do 6. I know he deserves something, but sometimes I feel they go overboard when you can't afford a lawyer. I have heard of murders, rapists and other violent offenders getting less time than he has. But I guess it all depends on the judge too, and the one my husband had was a politician judge, who threw the book at him. Oh well it is what it is.

My son got strong armed robbery, recieved a strike and 3 years, the reason my son got 3 years was a pled deal due to the guy was a big time drug dealer, he called the police, yes he called them and they busted him 2 weeks later. He was spun he didn't even clean up just kept making/selling the meth and making money.
Get a good lawyer and pray for the best.

A lot of it depends if it is state or federal. You only have to do 4 years on a 12 year sentence for a violent offense in state?? I thought more and more states are requiring violent offenders to do 85% of their time like the feds do.

A 12 year sentence in federal means you would have to do about 10 years and all your guy has to do is 4??? What state is that??

And are all the times listed in this thread state or federal?

ThatOneChick

I listed 10 years, and he has 85% at the state level.

He got 15 years total for two counts. He had a stupid pellet gun with him. Definitely wasn't the brightest choice he ever made.

for only one count, 30 years robbery wpn/not deadly he has to do 65% of it with controled release the rest of the time.

I know someone that got a life sentence for first offence and no one was hurt... thats Florida for you... it really depends on where they are at and if the judge is on the rag and wants to take it out on someone...

My fiance got 12 years suspended and sent to a juvenile program (he's 19) for 18 mos, got 8 left. But if he gets into any more trouble he does the 12 with 85% to serve. His was 1st degree burglary with a weapon.
