Default Help My Husband With His Worthless Attny!!!!!!!!!!!

Can anyone help me with my husband's worthless attorney? He is in WMCC on violation. Because he wouldn't plea, the "evil people" added 2 more charges...
I had already paid his attny 80% of the original cost & now with the 2 new charges (added 2 weeks ago), more $$ was added to the cost. I have run out of money. I have exhausted all avenues for borrowing money. I have even tried to get a loan.
His trial is in less than a month, this attny won't do anything without the money. We need to have only 1 person depositioned, but she "won't go in the hole to pay for it".
DOES ANYONE HAVE ANY IDEAS FOR $$ HELP?? ANY COMMITTEES, COMPANIES OR PARTIES THAT CAN HELP ME????
I KNOW THAT MY HUSBAND IS NOT GUILTY OF HIS CHARGE!!!!!!!!!!!
PLEASE, SOMEONE HELP!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

UPDATE - - - - - -
JUST TALKED TO THE WORTHLESS ATTNY, I explained to her that I am not able to come up with the rest of the money, she told me & I quote!!!!! "The last time i talked to a judge, they had done away with slavery!" & "He needs to plea then!" THESE ARE FALSE CHARGES & HE IS NOT GUILTY OF THIS!!!!!!!!!!!!!!!!!!!

Default Fire her!

If it were me in the same situation here is what I would do:

Have him tell her that his is going to fire her! Then tell her to file a motion to the court to remove her as his attorney and ask for a hearing to request a court appointed attorney due to no money. When you go before the Judge and she has to explain that she won't defend him because you are out of money the Judge is going to be pissed off at her!

She probably isn't going to want to go before the Judge and tell him/her this. I know that I had a hard time finding a good attorney because everyone I talked to was so high priced. They wouldn't take me unless I had the money to go until the end because they said (several attorneys) that Judges most often won't let them out of a case just because you run out of money.

If she refuses to file a motion on his behalf, call the clerk of the court and ask what you have to do in order to get a court appointed Defender. If you have used all of your money and assets you should qualify.

Worst case scenario you get a court appointed public defender..that's not great but a lawyer that's not doing what in his best interest is worse.

Good luck and let me know what happens. I am not a lawyer, but I probably talked to 40 of them over the last year about both my criminal case and the lawsuit that my ex employer (THE VICTIM) filed against me. I started out defending myself (pro se) until I found someone I trusted.

I'm not far away, Kansas City, at least until my sentenciing on July 31st.

Laura:
She has already asked the judge to be let off the case & he asked to have her removed. Judge told her that she has to defend him unless he gets different representation.
She told me today, to have him fire her. Then I reminded her of what the judge said. Then she refused to "argue" with me anymore.

Default ANother worthless attorney!

I hired one for my son and gave him a BIG chunk of money of front like he asked..he has done nothing and it has been a month..hasn't even went to see my son in the Co. jail! Now he wants the rest of the money that he said I had 90 days to pay.. and he wants it now and he hasn't done anything? If I fire him..I have lost all that money and there is NO More to be had! He is looking at LIFE without Parole without a lawer and this is what he will get with a P.D. for the courts have no respect for them in the first place! There were 6 of them invoved in this crime and the others have all turned against him so he will be taking the fall for them too!
Also heard that a Lawyer can drop a case if he wants..is this true? HELP?

I'm not understanding why you would lose the money you already gave him. When you give money to an attorney, it's suppose to be on a "pay it forward" kind of thing. Let's say you give him $2000 up front (called a retainer) then promise to pay another $3000 in 90 days. When you give them that $2000 retainer, that's exactly what you are doing..."retaining" their services. They start working on the case and as they work, they take money from the retainer fee to pay his/her expenses for the case. Any respectable attorney will give you a statement about every 30 days or so, provided they've done something on the case, to show where that money is going to. If he's not done anything like you said, if you fire him, you should get most of your money back.

As far as an attorney being allowed to drop a case, not so. In most cases the only way a judge would allow that is if it's a really, really good reason (conflict of interest as one example). Just because he hasn't gotten the rest of his money is not a good enough reason. Now granted, he may not give a very good defense, but an attorney can not drop a case "just because". They can try but it's doubtful the judge will allow it.

Thank you so much for your reply! I found out he has sent out 3 Supoenas and showed in court twice and asked for a different judge.(well, his partner did.) Still..he hasn't even been to talk to my son and get his statement or read this phony statement he wrote at the police interrogation with 8 Detectives "helping" him and his Prelim is next Mon. the 15th! I don't understand this.
I had to hire a lawyer for myself one time and he was in steady contact with me. I have called my son's lawyer twice and he hasn't returned my calls and this was 2 weeks ago. I have some info for him! He hasn't asked for a Psych evaluation nor mentioned any of his long term health problems. He could have gotten his medical records but there isn't time now! He has Chronic Active Hep C and Scrhosis? of the Liver and on a Transplant List and ADDHD that has carried over from his childhood and is Bi-Polar... to begin with. He has had the Hep-C for 20 years and there is NO cure yet. but the average Life expectacy is 25 to 30 years. If he gets anything from 10 years on..he will die in Prison.

These attorney's need to be reported..Call the president of the bar in your state...Call anyone, or maybe someone here know's exactly who to contact.
Maybe you can file a grievance in court

My friend is a JA to a Judge...everyone talk's in the court system..why not call the judge's chamber's...you will get his JA..tell your story and plead what to do...word will get out..don't you worry!

I would get in contact with him or his secratary and make an appt to see him asap. Ask him what his game plan is for your son. Take everything with you that you have to show him/give him. You are paying for his services. Take a pro-active stance and be willing to do whatever it takes for your son. Let that attorney know in no uncertain terms that you are going to be involved with your son's case. Maybe then he'll get the picture.

Hi you can do a search for pro bono attorneys in your state/area. Make sure you search for one related to the crime committed. Also in searching for my own info I came across this and thought it might help in this case and others who need to comlain about the attorneys fees. Im sure needless to say they are legitimate claims and the attorney is in fact doing nothing for you. Scroll to bottom for complaints http://www.mobar.org/d5fe59c0-0360-4...9c61abd94.aspx

Thank you all again for such great advice! I am going to make an appointment to see him for sure! I don't like this last minute stuff for any problem!
I so much appreciate this Forum..I've always wanted a place where I can either vent or get good advice from people that go through the same things as I do or similar!
This is such a stress reliever for me!

I don't think it's possible to find a more knowledgeable group than the members of this forum!! If someone doesn't know the answer they are usually able to put us/you in touch with someone that does!! It doesn't get much better, does it??
