John Spirko receives 5th (now 6th) stay in Ohio

I know this has been a nightmare for both Tracy and John. A terrible roller coaster of emotions.

Governor grants condemned inmate 5th reprieve

COLUMBUS, Ohio - Gov. Bob Taft on Friday granted condemned killer John Spirko a fifth reprieve from execution, guaranteeing that a new governor will decide Spirko's fate.

Taft agreed to the request by Attorney General Jim Petro to delay the execution to allow more time for DNA testing in the 24-year-old murder of an Ohio postmistress.

The four-month reprieve delays the execution until April of next year.

Petro asked for the delay at the request of Spirko's attorneys, who say they can't finish the testing before the scheduled execution date.

Additional testing is being done on a tarp that held the body of slain postmistress Betty Jane Mottinger and two rags found in a field nearby.

Spirko, 60, who says he is innocent, was convicted based on witness statements and his own comments to investigators.

THis case is just such a farce.... anybody with any common sense could look at this case and see what an injustice is!!
My heart goes out to his family.. (Sorry i have read about you on John's site Tracey but ive never spoke to you before so HELLOOOO *waves*)
Lets hope justice prevails and he gets out of that hell hole once and for all!!!

Tracy ~~ I am also happy to hear that John has received yet another stay. His case gives all of us the hope that there are people out there that do care when a horrific conviction has occurred by those who don't want the real truth to be known.

I am also involved in just such a case but we are just now about to begin the appeal process hopefully sometime in 2007 he will be assigned hiis appellate attorney.

You and John give me hope and the strength to continue this fight against the injustices that are going on in this country.

Stay strong and never give up. We can't let THEM win.

great news and nothing makes me happier than hearing about someone getting a stay or their sentence commuted and better still getting their freedom back, i will keep you both in my prayers for a positive outcome
