Default Parole and Location

I have made a good friend in prison in Iowa. I live in Texas and was wondering if upon his parole if he would be able to come stay with me. I havent asked him yet, thought I had better find out if he would need to stay within his own state.

Thanks.

I am going to go out on a limb with the CD and say no. Check with the Iowa DOC and see...assuming that this is State prison?

The parole thing would be covered by the Interestate Compact. You would have to have your friend apply for an interstate compact move. Technically this is a move to be with family, spouse, or where there is a better living siutation or work situation. This compact does not specifically cover same sex relationships, but I have been told that my partner and I would qualify if we applied.

If you cannot do this then he would have to live out his parole in the state that he is in.

ELIGIBILITY OF OFFENDERS FOR TRANSFER UNDER THE COMPACT

The following conditions must be met by all offenders to be considered for transfer under the Compact:

1. Must be in substantial compliance with the terms of supervision in the sending state; and
2. Must be a resident of the receiving state; or
3. have resident family in the receiving state who have indicated a willingness and ability to assist as specified in the plan of supervision; and
4. Must be able to obtain employment in the receiving state, or have a visible means of support.

If you have the right parole officer, they will do an Interstate Compact for a same sex couple. I have several examples where this was done as well as my Partner's parole officer instructing us that we would qualify as I am his means of support.

I agree with Ken that an Interstate Compact is possible. A request from out of the blue would probably be denied, but if you and your Baby meet with the parole officer and he gets to know you, it makes the process more personal and therefore it becomes more probable the request would be granted. A good reason to believe the Interstate Compact will be approved is that parole/probation officers are overwhelmed with clients. If there is a chance to lower their caseload, they will do what they can to make it happen. Just hang in there, be patient, work the system, and things will work out great for you!

In our situation, Frank must first pay off his restitution before we can get the hell out of Florida.
