Default Common Law Marriage Form

Common Law Marriage Form


On common-law affidavit, the common-law wife's affidavit has to be notarized. The offender/husband's affidavit does not have to be notarized, instead of the notary subscription, use the unsworn declaration " I, inmates's name and number, being presently incarcerated, etc. When the offender has these two affidavits ready, he needs a visitation form where he will change his wife's status from friend to wife. He then sends these three items (his affidavit, his wife's affidavit and the new visitation form) to Inmate records for approval. Offender is notified when request is approved or denied.










Affidavit of Common-Law Marriage


I__________________, residing at ____________________________________,
on my oath say and declare that the statements set fourth constitute a true, correct and complete statement pertaining to and declaring:

1. I am the Common-Law Wife of _______________________________,
(Name and ID#)
residing at ________________________________________________.
(Name and address of unit)

2. I am not presently married to any one else. The approximate date this common-law marriage began was _______________ and it was publicly known at this time.

3. I am not related to this person as:
A. An ancestor or descendant, by blood or adoption.
B. A sister or descendant, by blood or adoption.
C. A parent's sister of the whole or half blood.
D. A daughter of a brother or sister of the whole or half blood or by adoption.

4. There is ___________ child from this marriage.

5. Pursuant to the Rules and Policies governing the Texas Department of Criminal Justice – Institutional Division, I am requesting contact visiting privileges, the same as any other Wife might be entitled to with legal (common-law) marriage.






Make sure this is what the unit wants before submitting it. Some units require different proof but if they tell you to write up something, this should work. Good luck!

my husband is @ gurney unit- we common law marriage- we wear our rings and all- how should i go by to request common law marriage visits- should i wait for his form or start my own????

He needs to send you a form i think it's calls i-60 & PERS 530- if not someone will correct me- one that he fills out & a blank 1 for u- u get it notoarized(i got it notarized @ a PLS check cash place) & send his back so he can sign it- & send yours to inmate records- give it some time & call inmate record to verify is it was approved.

If an inmate is in ad seg, they don't get contact visits. It's too much of a security risk. They are placed in ad seg because they pose a threat to the unit's security and safety, i.e. they are gang affiliated and/or they've had too many assaults against other inmates and/or staff. JLH

Question: I asked someone at the Estelle unit about common law marriage, what we needed to do, etc and she acted as if she didnt know herself LOL She put me on hold several times to ask someone else then said that he will have to write up something for himself then I have to do one for myself and have it notorized. Is the one for me to fill out and have notorized the one up there at the beginning of the thread? I guess then I send mine to him and he turns it in with his? I want to make sure I do it the correct way so there are no problems.

Default To be (a common law wife) or not to be...

I've been debating this topic with Sweetie for the past few months. We're getting married ASAP after his release but if he serves his full time left, that won't be until 2017 and I'm not trying to wait 10 years just to TOUCH my fiance! The other thing is, from what I've learned, part of the requirements is us living together and since I just "met" him last year and won't see him for the first time in person until November this year, we definitely don't fit THAT requirement. Add to that that I live in Missouri (which recognizes but doesn't "perform" common law marriage ceremonies) and Sweetie's in Texas (which recognizes and allows it) How strict are the rules for becoming a common law couple? Are we allowed to get married for real after becoming a common law couple? Is it worth the trouble?

That is what my husband and I did 4 months ago. We have been friends for 15 years and loved each other most of that. If you want to get contact visits, that is the way to go, I love it! Is your boyfriend in Ad Seg?

We used the form and it worked (my man is at Garza West)! Had NO problems at all and our contact visits have been wonderful!!!! It felt SO good the first time they said "wife" and "contact" instead of "friend" and "regular visit"! Good luck!

Sorry but I don't think the form works if they are in ad-seg but you should call the unit and ask them. Good Luck!
