Talking Husband sentenced today.

So my husband was finally sentenced today, and (jumping for joy) the PD was able to get it dropped from a felony to a misdeameanor!! He was sentenced to 360 days, but will get out after he has served 30 days, and he has to pay a small restitution. For whatever reason, they are not giving him credit for time served in TN before being extradited (lawyer is fighting this), but worst case he'll be out by the 21st!!!

I am so excited and relieved. I've been so worried that he would end up with 1-5 years, so I can deal with 2 more weeks.

they did that crap with me back in 85. i was locked up in florida, didn't fight it plus rode around 2 weeks in a van in shackles till i got up here and i didn't get credit for 1 day. i'm happy his lawyer worked out a good deal for him and that you guys will be together soon. that's what really counts.

Well, we won't actually be together after he gets out. He has to stay in KY and get the medical treatment he needs. The doctors there are doing it all for free, and there is no way that I could afford it here or get it free here.

I'm just happy that he will be out soon.

It depends on whether he had other business in Tennessee that could be charged to his account as to whether he can demand credit for the time there. If he had NO OTHER PENDING CHARGES and Tennessee was just holding him as a courtesy for Texas, then he is entitled to credit for every day. I had to go to court to get credit for all my county jail time, but finally got it.

Oh, I thought he was in Texas.

Look under "U.S. vs. Canada" (named for defendant Roger Canada). Judge ruled state had to give Mr. Canada credit for every day he was locked up, even days before a decision on his violation had been rendered, because he had only ONE case pending and would otherwise have been set free for those days. It's not a statory law, but case law (precedent). I looked it up in the law library in prison and cited that in my petition to get credit for all of my time served. (sorry, can't remember the year of that case, I think it was back in the 1980s.)
