I can see the 5th circuit over turning this and saying that a judge and DA having a secret affair during a capital trial is ok. Just like they said a sleeping attorney is ok also........

At least this is a win for now. I wish Charles all the best and hope he wins a new trial. He sure deserves it.

I agree that a new trial is in order. How fair could his trial have been with the DA and Judge sharing pillow talk?
