Default Deported and brought back on PV - Have questions?

well heres my situation. my fiance is currently in a san bernardino county jail (adelanto). He was actually deported 09/2007 to tijuana,mexico and living there ever since until 3 wks ago.. when on one of my trips to t.j. My new car of just 2wks was stolen from in front of his house. So i had to take the greyhound bus to go home so we took a taxi to san ysidro border and my fiance was helping me with my luggage cuz i had to walk across and the line is long so when i was about 50 people away from crossing over we kissed goodbye and he proceeded to walk out of line back to catch a taxi and go home when a officer said he looked suspicious although he told him he was just helping me with my luggage. but the officer just took him to a room and kept asking "where the pounds at" and searched him and didint find anything but they ran his name and there was a warrant from san bernardino on a violation of probation. BUT THE REASON WAS CUZ THEY DEPORTED HIM!! So they transported him to san bernardino jail, its crazy cuz they dont want him in this country but they brought him back!! Now he pleaded not guilty to probation violation and has his next court on aug 3.
So im wondering is there anyway possible to keep him in the usa. he was convicted for 2 possestion of controlled substance charges which is considered an aggrevated felony. does any one know if after u been convicted of a crime can u appeal it or what?cuz i think the only way (if any) to get him to stay is by geting one of his charges droped or something?

ANY THOUGHTS OR INFO GREATLY APPRECIATED!!!

Wow that is just crazy. Hey we don't want you coming to this county but we will pick you up and bring you back. Is that allowed????? I won't think they could take him from Mexico? Did you talk to the consulate?

I have no idea about keeping him here. Hopefully someone else can help you. But I do advise you to consult with a criminal immigration lawyer.

Wow...that's a mess. The system can't make up their minds...they just like to make it hard.
I think that if you marry him that'll keep him here. My cousin got paid yrs and yrs ago to marry this jamican so he wouldn't be deported. And of course they devoriced after everything was finalized for him to stay in the usa..So Hopefully that'll work for you.

not the same anymore...back in the day you got married you were all set. Now Immigration doesn't really care if you are or aren't. You need to prove extreme hardship.

Any sort of drug charges are hard to overcome. Those charges would have to expunged or pardoned, which isn't easy or cheap to do, in order for him to have any chance at all.
If I were you, I would contact the Mexican consulate or an attorney, because what happened doesn't seem right to me. He has rights and it seems as though they could have been violated.
