Those aren't stupid questions. A stay is a *temporary* suspension of a legal proceeding. One would need a stay of execution in order for the court to hear an appeal or writ.

Generally, clemency would mean a reduction in sentence.

A court would grant a stay. A governor would grant clemency usually based on the reccomendations of the state board of parole and probation.

Possibly. A stay can be granted while the court reviews an issue. The court can then order a hearing, a trial, or can terminate the stay. If the person is granted a new hearing he could lose there and go back to death row. Sometimes they do win though so we must always remain supportive and posittive. If you need help myotherhalf, with a specific case or issue, feel free to send me a pm.
