Default DA tools for 100% conviction rate CONSPIRACY

This is my first post on prison talk. This post is what i believe is the future of drug convections. I live in Wisconsin and since 2008 the state of Wisconsin adopted a new tool to suck every dollar out of people have people admit to crimes they didn't commit. Two years ago i was awaking to the sound of DEA, FBI, state police etc. kicking in my door putting guns to my family. When they came in they called out someone elses name and continue to tear my home apart. They found nothing and took me to jail. They called the case the largest in state history. They arrested 16 people in the case. In the inditment it said that 4 people were the ring leaders and the rest were the said were seller addicts. When i was arrested they asked to talk to me and i ask to see my lawyer and never gave a statement. They charged me with conspiracy to deliver cocaine >40 grams and Conspiracy to deliver ten thousand grams of thc total years up to fifty two years in. In the complaint the dea word were he could have, could be, based on there experince you get my point. They had no edvence at all and wern't sure i was envolved. It took them 52 days to charge me after they talked one of the other people into saying i bought some coke from him. The case draged on for two years and i never was interviewed by the DA or any law enforcement. Out of the sixteen people arrested everyone took a plea. I made a few phone call to one of the men arrested in the case cause i was supposed to cater a party for him and in one of the calls i asked him for 1,000.00 as a down payment for the food. Thats it and i was facing 52 years in prison But witness told the da that i bought coke from him and the cocaine charge was dismissed go figure so! the plea was for the THC but wait there was no THC stated by anyone in the case A matter of fact i didn't even know anyone in the case except the guy i was cating for and he told them i wasn't involved. Long story i had a past record from 12 years ago so i must have been a part of this. After exusting all my savings and the da wasn't budging didn't even want to see my proof i had to prove myself inocent. Iam sorry i have no fatih in the jury trial because you got punished more for using your contuial rights to trial. So guess what i took the plea for three years instead of the 52 i was facing. I have full custady of my 12 year old son and raised him alone since he was ten months. For anyone who says if you were not guilty why didn't you go to trial My answer is read the conspiracy law!!! This is a tool that miore da's and law enforcment are using not to have to gather edvience in the cases, and there not just using this law in drug cases the door is wide open

im going through something similar with my hubby. The fbi and the da make these drugless cases and try to charge you with twent five years or more depending on your criminal history. Its fkn disgusts me. I hate the mandatory minimums i hate the fucked up laws they have and i hate that they have so much power. Its disgusts me that there out here taking the smallest people in the drug chain blow the charges out of proportion and make it look like they r fighting the war on drugs....

Hang in there the longer he waits and i hope he didn't give a statment the plea offer will get better for him. In most of the conspirey cases. they don't have much evendince. they hope people will tell on themself and in most cases they do. Let the state make the case until he can plea to something he can live with. I wouldn't suggest going to trial cause he will get the max. It sucks that we have to accept shit like this. The war on drugs is a joke. they should go after the goverment employees who let the shit in.

That is what Nancy Reagan started. Think that is what most people want? It's bs- government is spending $28,000 a yr to incarcerate non-violent people for their own addiction problems. Forget rehabilitation, that will not happen until they get out and want it for themselves! So fill up the prisons, do not address the issues, and while your at it Congressmen (that have NO idea) vote to screw our children with cutting funding for public schools instead!

That 28,000 per year should be used for treatment don't you think? oh but that doesn't fill the DA's conviction rate and they know with out help for use of drug, they will be back in jail, which keeps the PO's working.

Our family is going through same thing! Man/Min is horrible on families. Something needs to be done. Judicial system sucks and is so crooked. My loved one was told he would get drug program, close to home, camp, and work program. ALL LIES-he is almost 600 miles away! He got the longest sentence than others on the charge. His role was addiction.

I used to think innocent people didn't take plea deals. $100,000 and two trials later, my husband is doing 7 years for an accident he didn't cause! Should have taken the plea.......

Omg after reading all this i am so worried about my husband now he was with these ppl and one of them doing alittle side work and got busted with some meth 127.5g they let him go as long as he would roll on someone high up well he never did...now they are trying to nail his ass with the big boys. And now they r saying he is chaged with Conspiray to sale 953.7g and the 127.5g of meth....i did not what to do to help we dont have money for a att and the one the court gave him sucks @ss big time.

What is really scary is they have way too much power and no accountability. No one cares but the ones that are being proscuted or their loved ones. It's nothing but job security for the whole system.

I'm sorry to hear that he is being charged with conspiracy. My husband was also charged for the same thing. He was working for the main person they were after (doing construction) and him and 20 other people were also indicted. He was charged with possession of a controlled substance with intent to manufacture/resale. They had no proof that he every bought meth, sold it, manufactured it, or had it in his possession at any time. He did have purchases of psuedo from the store and that is what they used against him. But, because conspiracy is someones word against his, the charge stuck. My husband was clean of the drug when arrested (they tested him) and had no association with the people at the time of the arrest. We were issued a PD (who was great, fortunately) and it took over a year to get through all the court stuff and 2 compitency hearings. He ended up taking a plea deal to lesson his time from the mandatory min of 10 yrs & was ordered to serve 6.8 yrs in Federal prison. If he had taken this to trial and tried to fight it, he would have been looking at possibly 15 yrs. (remember, everyone named is trying to lesson their time in prison, they will testify against him in a heartbeat. even if it is lies) None of the 20 people arrested walked away with no charges (keep this in mind) and no one saw less than 6 yrs in a federal prison. My advise to you is be sure that you go through every piece of paper the courts/arrorney sends you and more than once. you will find mistakes that will need to be contested & there will be things that his attorney will miss too. Be sure you get your motion of discovery too. that will tell him exactly what they have on him as far as why he was named in the conspiracy & what his involvement was. They have to provide that to you. If he has the opportunity to cooperate with the USAA and lesson his time, you should really consider this too. Remember that manditory min is 10 YRS. The only way the judge can go less than that is if the USAA agrees to go less. (that is what we were told by our attorney & the federal judge himself!)

My husbands wasn't drug related but he was convicted of something he didn't do. He wasn't even in same state and has witnesses. He was offered a plea and reduction to a misdemeanor and no jail time. He refused-said I will not plea on something I didn't do. Rumor has it that the accuser is a CI and is how my husband got convicted. I believe it as my husband has witnesses to prove where he was and the courts would not here it! I do not believe in the justice system!!!!

You hit it on the head all the sudden they pull a ci out of the hat. In my case no one said i was involved until 52 days after the arrest. The punk who said he sold me drugs was caught 34 times selling to a cop. My name was never metioned before in 32 bust. All of the sudden he takes a plea They gave him 2 years off is sentence for every person he would put into the consparicy. The punk still got twenty five 15 in 10 out. I was the only one out of fifteen who didn't give a statement and lawyered up and had no involvement. Still had to take a plea CONSPARICY IS THE WORST CHARGE TO BEAT AND YOU DON"T HAVE MANY RIGHTS IF ANY AT ALL>

It is very scary. I used to believe that living in the U.S. and having the justice system we do was a privilege that we were fortunate to have. After what we have dealt with I am a firm believer that changes need to be made. Why should a person have to go just about bankrupt trying to prove their innocence and how can the courts just refuse to hear evidence? I DON'T call that justice!!

Slowly but surely we are loosing more and more rights in this country. I pays to look into new laws for the new year. especially if you have someone on probation or parole. The pass them in close door sessions and fail to inform the public to them, but if you get caught they tell you you should have known the law. Every state is different with passing laws. The Amercian justice system works for the rich. The rest of us are bed fillers for state income and federal funds!

Many of us have witnessed first hand the STING of this corrupt system and it is truly a scary reality, when we see first hand how it really works (or should I say how it doesn't work.)
Power and Politics have really taken over. Outrageously long and harsh sentences are doled out for political purposes.
I wish to heck the American public would wake up. They are right there ready to judge and convict on a whim. If they really knew what was going on with this system they would think twice.

Figures it would be in Wisconsin my husband and I were part of a consipracy in Wisconsin also and it was all based on what people said, out of the 50 people that were questioned only 4 knew who my hubby and I were one of them said she knew who he was but my hubby and I never met her we seen her at the bar but thats really it. all in all I do agree the detectives make up lies, emblish the truth and dont realize the harm they are actually doing, like your story my house was also raided nothing was found they took my hubby in may 2009, and finally made it to his prison were he will spend the next 10 years. So i know your feeling because my hubby and I went trough this.

Have you known of a case not indicted by the grand jury? So the DA/USA gathers up with this group of people, tells them all the bad things, the police story, that this people said this and that, and then they indict you, they never get to hear your defense. Why they dont put someone who has gone trough some sort of police experience? even if one gets the chance to, most will concur to put the person in jail, I think that the only fair legal systems are seen on TV. "Law abiding citizens" just hear convict, felon, and they think just the worse.... In these nowadays a person in jail is money, ordinary people gets rough sentences, government people which should get a longer sentence, gets just a slap in their hand... Now, good attorneys who are willing to defend you and do the necessary research dont come cheap. They hire the best people out of law schools to prosecute, and the worst to defend you... Those public defenders are just lame... but in most cases you end up making a plea bargain, at the federal level is just a waste of money to employ a expensive attorney if youre just going to plea, the public defender and the expensive attorney are going to do the same job, the only difference is that you can call the paid atty whenever u want for info. and actually the only attorney (federal court) who I saw doing his job defending against illegal search, was a public defender, however his motion was thrown to the trash by the magistrate.I deviated from the topic, but this crooked government always find something to charge you with, or conspiracy because you knew, or lying to a federal agent because you didnt tell, or obstruction of justice and the list goes on forever...

Conspiracy because you knew and didn't tell? Oh boy, you are there for your own addiction and you should tell? The system is NOT to be trusted! Crooked from the top down, playing that they are on your side. In the end your hands are tied and they have you! My loved one was given man/min while most others in "ring" walked or sent away to a camp for a lot less time. Makes me sick-we are heartbroken!

until you are in the bazaar world of a conspiracy charge, there is no way the general public has any idea about the injustice written into laws by the "justice system". Our country is in trouble and our system is broken....but we still must fight for justice! Fight for change and reform! Never stop fighting! Once we have become aware of an injustice, we must not ignore or dismiss it....we have to act on it...in some manner. Thank you for sharing your story. I will keep you in my prayers

It's good to know there are others who have taken the time and effort to research some of the crap in our justice system. The term, "innocent until proven guilty beyond a reasonable doubt" is such a joke because it's just the opposite. It takes people like us, regular joe publics to call them to the rug on these things and make them aware that we are watching what they do. I had asked the lead Criminal Investigator Detective what the exigent circumstances were that caused him to tow my grandson's car and haul it to impound. He replied, "What does exigent circumstance mean"? We got the car back, the county paid the towing bill, no impound fees were charged and the Cheif of Police called me and said the investigation was dropped. This is only one example and I'm sure many of you have your own experiences with untrained authorities that want to do things their way. What a mess huh?

The thing that gets me is how the police can have someone, sell you drugs isn't that drug dealing?

Follow Brady v Maryland and the effects of plea bargaining on the obligation to produce evidence.... couple that with right to lie to secure a confession and you have our current CJ System...................
Oh, and the first take a plea/point the finger wins????

That what happen in my case i didn't even know the people charge. i made a phone call to a number that was being tapped, cause of that phone call i was arrested. In the first interview by law enforcement no one even new how i was. I wasn't charged at first 53 days later after the DA was handing out pleas. All the sudden one guy said i bought cocaine from him, but at first he didn't know me. The craziest thing is i was charged with conspiracy to sell THC. I was told to take the plea of go to trial and face 52 years. The state burden of ha right in conspiracy cases there is none.
