Question Sb 5891 - passed

I need some clarification on SB 5891.

Among MANY other things, this bill addresses 50% early release:

Section 3(c): (Lists all of the people that are NOT eligible for 50%)
(c) An offender is qualified to earn up to fifty percent of
11 aggregate earned release time if he or she:
12 (i) Is not classified as an offender who is at a high risk to
13 reoffend as provided in subsection (4) of this section;
14 (ii) Is not confined pursuant to a sentence for:
15 (A) A sex offense;
16 (B) A violent offense;
17 (C) A crime against persons as defined in RCW 9.94A.411;
18 (D) A felony that is domestic violence as defined in RCW 10.99.020;
19 (E) A violation of RCW 9A.52.025 (residential burglary);
20 (F) A violation of, or an attempt, solicitation, or conspiracy to
21 violate, RCW 69.50.401 by manufacture or delivery or possession with
22 intent to deliver methamphetamine; or
23 (G) A violation of, or an attempt, solicitation, or conspiracy to
24 violate, RCW 69.50.406 (delivery of a controlled substance to a minor);
25 (iii) Has no prior conviction for the offenses listed in (c)(ii) of
26 this subsection;
27 (iv) Participates in programming or activities as directed by the
28 offender's individual reentry plan as provided under RCW 72.09.270 to
29 the extent that such programming or activities are made available by
30 the department; and
31 (v) Has not committed a new felony after July 22, 2007, while under
32 community custody.
33 (d) In no other case shall the aggregate earned release time exceed
34 one-third of the total sentence.

Section 4: (The last sentence)
Subsection (3)(c) of this section does not apply to offenders convicted after July 1, 2010.

So does this mean that those restricted from section 3(c) convicted AFTER 7/1/10 are now eligible for 50%?

OR does it mean that those convicted after 7/1/10 are not eligible for 50% at all????

I am not sure but I read it as they the conditions only apply to those convicted before that date, that anyone after that date the 50% is automatic.

That's how I read too... at least the first 12 times I read it lol

Then I took sometime to think about it and (considering our government) I am thinking that it might mean that anyone convicted after that date isn't eligible at all. As in the entire section, including the first sentence doesn't apply.

Any other thoughts?

I looked it up. Sounds like it was signed by gregiore....does that mean it is in effect now?

I hear they are starting to implement it, but they are having a special session November 28th. We shall see...

Wow it sounds like a lot of people will not be effected by this just reading 15 (A) A sex offense;

My Fiance' is in for a drug offense and a violent offense that happened in 2003 so that means he is not eligible right?

I think this bill was just too "add" that certian offenders, like Sex offenders, could be denied release if they do not have an approved release plan in place. I also think that it did not really update anything to release the inmates that have been in prison for awhile. I want to hope that maybe his release date will be sooner. But my honey says, that he knows his release date is 2018 and he is going to stick to that. I will follow his lead. I am just so impatient! :P
