Default He was found guilty, what does this do to his time?

Ok, on 5/23 they had a shakedown and they say they found a lighter under his bed. Ya'll know this is a class x offense.

He didn't elaborate on all the details of this for fear of someone reading his mail and I guess he didn't want them to know of his recourse.

He did say that it was good news and he thinks it may be dropped.

Anyway, he was supposed to discharge in August. His parole date is listed as September. His sentence is listed as December being it besides the probation beginning on his release.

So, because of this class x, if he is not discharged in August because they drop his level and all again, should I prepare for a parole hearing in September? When his sentence is up in December, does that still mean anything? Or will they really keep him an extra year or whatever for this write up?

It will depend on how much good time they take from him. A class X I believe they take 365 days. And if it was a class X don't look to the parole board to parole him.

Prison overcrowding, the cost of keeping him and they will keep him another 365 days for a lighter?

This is one of the reasons i make careful consideration when i write someone up for something. To me a class X is serious, adding more time to what they already have to do. Strangely enough the inmates dont act as though its a big deal. I gues part of that could be just a front they put on for the other inmates.

Update:

So basically, instead of being home in 2 months. He now has to stay until November 2006 for a freaking lighter that was found on the floor.

Can anyone say, no wonder there is prison overcrowding?

A answer to your question " I guess they put on a front" Yes they have to because the other KNOT HEADS "some inmates" will beat the crap out of them and this you know for a fact. And I might add only because this happens to us once! When speaking with a inmate about a miscondut, if you don't you might speak to them without other inmates in the office or room and you might get the whole story, if it's kept private.
When they wrote my son up a 1.5 ago in Granite the dang prison was in the office and my son wasn't able to say crap! He just took it! And it cost us alot of extra bullcrap and time! He'd be home by now!

Have to remember even tho they add those back he still gets a review I think 90-120 days. He could get levels back and extra days. DOC says it is rare that an inmate ever does the full time sentence.
So I believe that if he was sent back down to level one in a few months he could be eligible for level two and then I think they add 22 days for each month for their credits or good time.
Check this out and see if it helps to explain it some.

Even if an inmate doesn't say anything at the time of the bust or contraband find, he still has chances to speak up when other inmates are not around, there is an investigation process and more then one person will speak to the inmate or inmates alone to get their story. The reason why "some" inmates act like it's no big deal is because they think they can beat the misconduct. Wannamae knows what she's talking about.
