Question Judicial Release-Judge & lawyers to discuss it or will they have my husband come too?

My husband had filed for Judicial on 4/14/06 *thats when it was filed in da courts clerks here in clermont county* and on 4/18/06 I checked on the computer @ da clermont county clerks office and it said that he goes up against da judge that sentenced him on 5/1/06 *1st hearing* anyways my husband was sentenced to 5yrs but when he was sentenced da judge told him to filed after 2 years because thats basically all he would have my husband to do. We are excited but he has to think he will get denied cuz .. he doesnt want to get his hopes really high and get them knocked down. Anyways my questions are..

First hearing - is that for just the judge & lawyers to discuss it? or will they have my husband come to da county jail and he will have to be present? cuz they didnt say on the clerks about him not being there...

And my husband fired his lawyer after he was sentenced so should I get him an lawyer before this hearing??

and Also .. do first offenders get denied usually the first time?

I was just wondering cuz it was such a quick response of him gettin a hearing so quick i mean it took only 4 days and usually.. my husband talked to most guys that has gone for judicial and said thats unusually to get it so fast usually it takes awhile to hear back...

My mind is goin round and round.. in circles.. Im so excited but Im so scared also.. So thnks if you can help me with all of this...

hey girl, if you got a hearing that's a good thing!! Most of the time they just deny them with no hearing and no reason why they were denied. 90% of the time, if you actually get a hearing, there's a very good chance he will be released. BUT, on the downside, if he is denied at the hearing, he CAN NOT file again.....EVER! He would have to do the rest of his time or wait on the parole board. SO..........I wish you the best of luck on all of that!! I'm sure it will be fine.

i know here the judges most likely send denies thru the mail rather than having them come all the way down here and go infront of the judge.

and also the judge said come back after 2 years and that in the files he told my husband that he would only have to do 2 years no more. so who knows.

everyone we have talked to thinks my husband is coming home. even my moms friend *who did 10 years in prison* said mostly likely my husband is coming home. i mean i think if he doesnt come straight home he will be going to CCC cuz my husband had already gotten into it .. but the judge thought it would be better to send my husband to prison for awhile..

I have my hopes up and praying that he comes home. and all but I dont want to get them shot down. But I do feel that he is coming home tho.. but i think thats sorta fast gettin a response from the judge that quickie and i feel it would be stupid if the judge was goin to straight up denied him when he could of just respond thru a letter which most of the time what happens.. So I do believed this hearing will determine if he comes home with me or he goes to CCC.. which either way I dont care I just want him out of PCI... but i would take him coming home with me.. I mean gosh im still in shock how i could be sleeping next to my husband.. in 11 days .. freakyyy out!!!

My husband got his judicial release on Jan 3, 2006. He was present. If they send notice for him to be there he will more than llikely be released. Ohio doenst usually waste their time or money on a judicial if he is to be denied.

thnks :] thats what i thought. so im thinkin probably if he was goin to be there they will send a noticed like this friday im just goin to keep lookin in the clerk courts dockets and on his case and see if they send itt... to him being there

but yeah everyone we have talked to from lawyers to family&friends to even ppl in prison/or been in prison that he is most likely coming home.. so who knows

im gettin excited.

Oh yeah they sent the info to the Adult Probation Offices here .. so i know a probation officer will come and check our place.. what is there i shouldnt have in the house.. i know guns arent but what else???

OTher than guns, we are not allowed alcohol or pocket knives. YOu can call and ask, they should be able to tell you what you do and do not want in the house. We live in Virginia and no one came to check out our housel I thought they would so I got it "ready" but no one came out....take care

I was just wondering how the Judicial Release Turned out for you? if he was released, How much time of the sentence did your husband have to serve before approved? My fiance (first time offender) just filed for Judicial & has been in for 5 month's of an 18 month sentence. I have been researching & speaking to his attorney & the only answer I ever get is "It's up to the judge you never know". I can only pray that he comes home to me.... I hope it all worked out for you!

He was approved for the hearing.. but since he was sentenced to 5 yrs.. as the law is stated sentenced to 5 yrs.. you have to atleast do 4yrs.. then after that 4yrs you can file for judicial.. so. basically my husband has 2 more years to do.. then we can file again.. but the judged denied the jR behind chambers so it didnt count against my husband.. THANK GOD! cuz if he did it in the courtroom my husband would of had to do all 5 years.

So your fianced was sentenced to 18 months.. Im sure.. he will be approved..but .. it all depends.. on what he was in there for and so worth.. it all depends on the county and plus the judges.. I hope all the best for you.. Go in with that he may not come home.. because if you are all excited and then if he doesnt come home... its a awful feeling... but i wish all the luck and keep me updated...

Thanks for replying, I really appreciate any input on Judicial Release! I am surprised that the judge allowed a hearing being that the mandatory 5 year requires 4 full years! But yes, you are VERY lucky the decision was behind chambers. (Good to know that too) Best of luck to you too!!

We are in Ottawa County- The judge is tough & I was shocked that he got 18 months to begin with and no record whatsoever. He got into a fight with my ex husband & was charged with aggravated assault. 4th degree felony. They offered a plea bargain of 5th degree assault & we turned it down in hopes that the jury would see that it was self defense, but the judge wouldn't allow any previous happenings prior to the day in question... therefore self defense was not allowed in court- we were pretty much screwed and the defense attorney that cost $10,000 was not much help in this case! Oh well, trying to move on from there... Sorry this is so long! My point of the story... getting back to JR- I am sure each county is different, but with your experience how long did it take from the time you filed for the judge to grant a hearing? I hate this waiting... Did you write a letter to the judge? I just mailed one, & I sure hope it doesn't piss him off!! Sorry, I am a nervous wreck, but like you said I will not get my hopes up for disappointment all over again!

My husbands JR was filed about 4-6 weeks before his release hearing, which he recieved. There is only a certain amount of time after filing that they have to review and make a decision. I cant remember the amount of time, but my husband could tell you. He isnt here right now or I would ask him.. I not only wrote a letter to the judge in his behalf, but so did his family members, a couple of friends and a few potential employers. If you can find someone willing to at least give h im an interview for employment, have them write on his behalf. The judge likes to see that he has a definate chance at employment. He also likes to see that the inmate is remorseful for the act tat put him behind the walls. Good luck to you and yours...
