Default Don Davis - AK - 5 July 2006 - Stayed

Don Davis is scheduled for execution tomorrow, July 5th in AK. Has anyone heard anything about that? Is it still slated to take place?

Atalie I did a google search on Don and most of the articles are stating that it is still being appealed.

Deathpenaltyinfo.org tells that it is stayed, but I dont know more about it.

After reading this thread earlier, I seemed to recall I had read somewhere regarding Don Davis. And upon browsing over some of my more recent e-mails; I discovered one that has an article explaining why Don Davis received a stay - as well as Arkansas executions in general. Sorry it took so long for me to recall, but this is undoubtedly very good news!

U.S. District Court for the Eastern District of Arkansas
Ordered: June 26, 2006

.. the court found that Davis had shown that he was "personally under a threat of irreparable harm." The court also found that an evidentiary hearing on Davis' claims would serve the "public interest in the humane and constitutional application of the State's lethal injection statute."

Good news and a good article. I could not believe the Dr said he was dyslexic and that is why there were discrepancy's in the amt of SP in the reports. Dyslexia does not cause you to put 2.5 instead of 5, it would cause you to put 5.2 as they turn it around not change the amt.
