Question Info Please! parole violation and they reactivated an old warrant

Hello to All!

I just found out my brother's in county for two warrants. He was picked up on Saturday for parole violation and they reactivated an old warrant for $143. My mom is worried sick about him. What happens now? We called the justice center and they told us we had to call back. I normally post in the Texas forum so I'm not sure where to look to get answers in the Ohio forum. All answers and advice is very much appreciated!

Well, I'm really not sure about the violation, but as for the warrant for $143, I am assuming it is some kind of traffic ticket or other fine. If that's the case, normally he can just pay it or have someone pay it and that one will go away entirely. My boyfriend was arrested for not paying traffic tickets around 11 PM in the evening, and by 2 AM I was on my way to bail him out. He didn't have to go back to court or anything after that, I don't think.

Not sure what they do in Ohio for violations, hopefully someone will come along with an answer for you.

Hey Panda,

I'm not sure about the violation either, but the warrant for $143 was dropped under certain conditions and the parole stuff had something to do with it. I guess since he violated parole, they made the warrant for $143 active again. I wasn't able to get any info. I was told to call back on Wednesday after 8AM.

Mroning!

I called the justice center and they told me when a person violate their probation, the probation officer usually let that person sit in jail for at least two weeks before they go before a judge. This "wait time" serves as punishment for the violation, supposedly. After that, they go before the judge and the decision to continue probation or serve time is up to the judge with recommendations from the PO. I will keep you posted.

Greetings to All!

My brother (Larry) went to court today and he said they gave him 30 days to six months. What kind of sentence is that? Larry also said he was being shipped to Lorain. What's the name of the facility there? Is there more than one? Does he have to serve all of the time? Does the time before he went to court count towards his sentence? Is this a day for day type of sentence? I apologize for all the questions. Any answers or suggestions are greatly appreciated!! I usually post threads in the Texas forum so I am not too familiar with Ohio correctional facilities.

That does sound like an odd sentence. I've never heard of a minimum as low as 30 days. I guess it's because it is a violation. Anyway, I will try to answer some of your questions. First of all, he is likely going to Lorain Correctional Institution (LorCI) for reception. If he is from the Northeast Ohio region (Cleveland, Akron, etc) they all go there for reception. There are three facilities there - LorCI, which is almost completely reception inmates, Grafton, and another one that I believe is a susbstance abuse treatment facility.

You will need to check the sentencing paper work (normally called the "journal entry") to see if the time that he served prior to being sentenced counts. His lawyer should recieve a copy of the journal entry in no more than 10 days, depending on if the judge wants to drag his/her feet for any reason.

I'm not sure what you mean when you ask if this is a "day by day" sentence.

My fiance was in Lorain for just over a month prior to being transferred to his parent institution. So if your brother only ends up serving 30 days he might never leave Lorain. If you have any questions about LorCI please feel free to PM me as I must've called them about 10 times with all of my questions. I haven't had to do that at Madison, they actually communicate pretty well with the guys what is and isn't allowed.

I hope this helps! Sorry to hear that your brother will serve time but hopefully it won't be too long.

Thanks Panda for responding and for the information. We were wondering if each day served count as "one" day or, one day count as "two" days served? Does that make sense? I may not be explaining this right.

In Ohio...sentences are served day-for-day.

Some local county jails may give you two-for-one credit when they are overcrowded, or, some jails give a one-for-three credit when you are a trustee or on the countie's work program (Mind you, this is misdemeanor time, not felony time).

My brother received a felony conviction-receiving stolen property and possession of criminal tools (a screwdriver). He violated probation which is why he is now incarcerated. I guess the credit thing doesn't apply to him. I'm going to call today to see what type of sentence they gave him. I will keep you posted.
