Default Federal sentence reduction and deportation

Does anyone know if this is true...a permanent resident serving federal time receiving a sentence reduction for waiving a deportation appeal. Any information that you all could provide would be helpful. Thanks so much.

Kind of sounds like if you waive the deportaion hearings and do not fight deportation then you reduced the amout of time till deportation. If you waive it then you are put into deportation procedings much quicker. If you fight it then you are in custody longer. Is this what you are asking?

We're actually wondering if time will be cut from his actual sentence of 10 yrs. He thinks that they may cut some of the time since he does not want to fight the deportation.

A sentence reduction for waiving deportation...I wish! I have never heard of that. Infact. From what I understood with my husband's case, because he is no longer a LPR once convicted, then he is ineligible for many opportunities for sentence reduction. He can do "good time" and that's about it.

Maybe someone else might know something more postive.

10 years is a long time. That must be very hard.

My husband also is not fighting deportation and he did not receive a sentence reduction. He was given 77 months in federal and he is only eligible for good time credit, so in all he is doing 72 months of the 77.

sorry but it doesnt work that way the time he does for feds is not connected to deportation. ice will wait untill his time is up will pick him up and move him to a detention center.dont let his passport expire this is very important! after his time is done and ice picks him up they have 90 days to deport him. doesnt usually take that long though about six weeks. but his passort must be valid.

If he is being deported to mexico he will not need a passport. This is what i've heard!

my husband did not fight,he asked to be deported.it was in 2000. since no news at all for his deportation.vero

You don't need a passport to be deported to Mexico. But it does help if you have some ID. My husband has a mexican DL-it at least has his picture on it so if he gets stopped and in Tijuana they do stop people on the street and ask for ID. We try to avoid even looking at the mexican police when we are down there. I have seen them ask someone who looks like he is mexican for id-if they have none they haul them in. Its crazy!

Ms Can't Wait,
You're asking about time off his actual sentence if he is willing to be deported is that right? I don't know about the feds but as least here in Louisiana, they have to serve their time just like any other person convicted for the same offense. Then they are punished again with deportation.

A friend of my ex husband is from Panama.And he was to serve a 20 year sentence in the US. But he only served about 6 and they sent him to Panama to serve the rest.So I dont think they let you go free. You just serve your time in your own country.My ex fought deportation and served his 14 years and was deported after that.I hope that helps.
