Default ohio judicial release rules

My man has been in Richland Correctional since April 17, 2006. His cousin called his court attorney so she could put in the paper work for judicial release. Vince thought that he should be getting out on January 6th.

The attorney said that the judge wants him to be in prison for a FULL 9 months. She said that she would put the paperwork through at the end of January and he should be getting out sometime in February after his hearing.

I cannot figure out how they are calculating the 9 month time. If he doesn't receive any "good time" etc. Common sense says to me that 9 months from April 17th is at least January 17th is it not?????

He was originally sentenced to 3 years and the judge said that she wanted him to be in prison for 9 months and then enter a 4 month rehab center.

How long are these months that they are talking about??

Can anyone explain this to me. We will have no recourse in this matter considering that he could be there for the total 3 years if we get anyone mad or upset.

From the way that I understand it, once that time period expires, that's the first opportunity that the attorney or inmate can file for Judicial Release.

Once it is filed, it's processed, a court date is set, etc., so it may take another few weeks in order to get everything set.

So once you have served 9 months, then you can file. We thought that you could file 30 days before, have the paperwork done and on the last day of the 9th month you would be released.

How long is a prison month anyway? April 17th to January 17th seems to me to be 9 months. Do they count by days??

The lawyer said she would file at the end of January which could be 2 extra weeks past 9months, for him to sit in prison before the filing. We heard that it may take up to 30 days to have JR go through. Vince is freaking out that he might have to serve an that extra time.

So in reality, you can file once you have served the 9 months the judge agreed to. Then you have to wait for as long as it takes for the hearing etc. They have to transport inmates to court for the hearing, which probably takes awhile to set up. He is in Mansfield and has to go to Canton court. Over an hour drive.

When they say 9 months, it really could be 10 months or more. Is that what you think??

Thanks for your help. I'm so confused, scared, exhausted and a little numb trying to deal with all of this. He spent time in jail before prison, so I have been alone since February 5th 2006. Financially, it is a mess. After he gets out, he has to complete a 4 month rehab at a "halfway house". He will have to live there for 4 months. Also, before he can get into that program, he will have to wait in jail for an opening. I guess things could be worse.
