Default Could go Back In

Well folks I screwed up this time and I could go back in for up to 18 months this time....I was caught in a hit and run & an OMVWI(oper. motor veh,. while Intoxicated)& Class 3 controlled substance(Loratabs not in the right container. I think I might be able to get of the Felony though. Not for sure yet. But right now I don't have my license(which is a CDL) and that is my livelyhood there. .I was severly depressed(still am) and was just trying to escape it all for the final time. What gets me is they (the courts) won't even try and listen or anything. My girlfriend/fiance is finally finding out what the whole Indiana Judcial System is all about.
I came out of this so far with a black eye,bruised ribs,bruised lungs,pulled shoulder,and bruises around my throat(funny I wish I knew how long the Patrol Cars keep the video).No, I don't think it was all from the wreck....that was pretty minor. But the injuries aren't. This all happend on August 20th/21st.....and was out of it 'til the 23rd which is when I went to court. I was In the hospital for 2 days and they never even contacte my family and such.
I am trying to seek help, but don't know what else to do right now.
Any suggestions for my girlfriend? Any for me. I am going to show her this website for the 1st time on Sunday. I would appreciate any and all coments whether god or bad. I respect all of you and have been enjoying it sisce May of '05

roadiez....Hello sorry to hear you screwed up....tell your girlfried to pm me any time. My husband has been on house arrest for 10 months he just failed a breathalizer and he was picked up monday the 28th. he will serve out his time. We got married in October of 2005. He was sentenced to 2 years on a driving while suspended....so Indiana laws oh yeah I will help her out.. we all need friends right now. I am in Texas and they would not let him transfer to me. It has been the pits. Video is kept for evidance it is not destroyed until after the trail if there is one. I do hope you are healing. My heart goes out to you and your girlfried best wishes my prayers be with you.

Also depending on your other trouble before will depend it you get out of the felony. My hubby is charged with a class C felony for driving on a suspended license he was not drinking nothing the only offence he did was drive with his brights on....better yet he was driving period. They are tough. They will not give mercy on Drinking. I wish I had better news for you. You need a good attorny and sorry I dont know one. I would not recomemed Boswell.....try to find someone really experienced in this I will do some checking for you. God Bless

If you have the correct container for the Loratabs, your best bet is to have it with you when you go to court. Better yet, have the read-out from the pharmacy where you had the script filled. I am sorry things have gone wrong for you so quickly. I know "hindsight" is 100%, but by now I am sure you realize there is no such thing as "escaping it one last time". That has come to bite me back in the butt one too many times. Good luck. I will keep you in my thoughts and prayers.

Sorry to hear about your troubles. Its tough to get out of those charges, especially if you don't have a good attorney. I know of one, who pretty much gets things done but he's in Kokomo and I don't know where you're at. If you send me a pm I will give you the name of the lawyer...a friend had him and he got out of his charges with a warrant being dismissed immediately. Good luck again in everything.

I am in Newburgh,In(Warrick Co.)...But my charges are in Evansville, (Vanderburgh,Co.). Right now I am nursing my back(injured it in the wreck). I really appreciate all of your "Thought & Prayers" And all of your words of encouragement.
I know That I can make it though.I know it will be a long hard road also. Thank all of you again for all of the support.

Well, I've been to court 6 times now....Go back again this month(Jan '07).
It has really put some strees on us here at home.... My girlfirend wants to call it quits for good this time , I can't blame her either(I am still living with her for now).
I have found out that they(the courts) are going to charge me with a DUI also...I don't have the right Rx for the Loratabs(I actually grabbed hers that night I was trying to do away with myself)I have 2 Rx's for the the lessor dose. Would it be a good idea to just tell my PD to just ask for mercy or to just keep on going on with what he is doing now? I am tempted to just go to the Prosecuter myself and ask for him to drop the DUI and charge me with the Felony of the Rx. And hope for Probation or something...Maybe move out of state....
I really don't know anymore.......
I have written a letter to give to the Pros. myself explaining what I was doing that night(I haven't given it to him though). But my PD is always in a hurry to just continue the case for another month or so.
This is what is causing so much stress. I don't have a job,I can't find one I like because I want a driving position( I know I could find one if I had my License back).We have run out od our savings and such and being MrMom isn't appealing to her anymore....
I am so tempted to just move out west when this is over because I know no one out there knows me the least bit.
ANy suggestions would be greatly appreciated I can take whatever you folks say.

Phillip first off Sending you lots of prayers You are a wonderful, strong person and God will not give you more than you can handle. I know you love driving. But something you are going to have to understand is that driving is over till your license is reinstated. With that said dont get in rut thinking that you can drive tomorrow cause you cant. I know that is a tough statement but I am being honest with you. You asked for it. As far as time served you could get probation or house arrest. Depends if they think you are risk to others. If you are on house arrest then you are back to where you are right now. You need to get out and get a job. I know flipping burgers or checking out at stores is not the best selection of jobs but it something that does pay. Sounds like you are depressed again and you are only sitting there and giving up. DONT DO THAT there are alot of things that you could do. Pick another passion and go for it.
As far as the courts that is a tough one. You said earlier you were in councling are you still going? Does your PD know this? Because you were hurt that is one reason the PD is setting it off. If you honsetly want it over and behind you tell him get this done now. You cant move forward till you get these charges behind you. Your license can not be reinstated till the time is done and depending on the suspension time does not start to clear it till your last release. So right now you are on hold. So my advice is tell the PD you want it done!!!!!! As far as the letter that is up to you the courts and PD are going to do what they are going to do I personally dont think it make any difference. Others might come along and give you some more advice I hope .....I got lots of prayers this is all taken care of quickly for you and you can move on with your life. God Bless you Phillip

Thank you for the response...I really do appreciate it...
I know my PD is(I think) trying to hold it off til I get about 6 months into the suspenson(although nothing OFFICIAL yet). But it just kills me not to drive....See i have another problem also...My mother has go to Cleveland,Ohio on the 25th... And no one even them (my parents) are sure they can drive it all from here. So, there is the second dilema.
I feel it is up to me(being the middle son & the only one able to) be the one to help them out as much as possible...
My older brother has MS(Markots Variant The most progressive) and my sister has her own family also...
So there I am again needing toget this resolved...
I'm sure it will work itself out sooner or later...I just need some advice and venting sometimes......

You vent all you need to here that is what we are for. I understand your delima but let me advise you If you drive on a suspended it is 2years and class C felony is it worth the risk? Phillip some times you have to trust god for the answers. If you drive your folks and get caught you are facing alot more time. they may need you now but they going to need more later. More time is not good and getting the time done that you face will get you to where you can help them some things are tough to let go But sweetie you ganna have to.

Phillip, I am glad you have been on here so we know what is going on with you. I know what you mean about just wanting it to be over with, and when we look back at what we have done that got us where we are now, we almost always think "What was I thinking!". I get the feeling they are bringing up the DUI charge now as a bargaining tool. Kind of like a threat. If they had thought they could use it in the beginning, you probably would have been charged with it from the beginning. Sunshine is right, flipping burgers is not most people's dream job, but it will get you thru. And you may be surprised, I know lots of people who work in fast food, and the job is not as dead end as it appears! I vote you go with your instincts. If you feel it would be better to just lay it out on the table and let what will be, be, then go with that. One thing I have observed, most courts appreciate honesty. I would advise enrolling in a program that can help you work thru the emotional trauma, because that is a second thing courts like, someone who is trying to help themself. You are a good person. Just the interaction on here shows that. We all hit low spots in our lives, and I have been to the bottom of the pit a few times. It is heck climbing back up, but I am stronger for everything I have learned and gone thru. One more thing, Sunshine is also right when she says your driving days are over until you have your license again. Even though your sister has her own family, your parents are family too, and I bet if you talk to her she will help get them to Ohio. I have you in my thoughts and prayers, and if there is anything you think I can do to help, just let me know. Remember, "There's no place like home, Toto". Good luck and keep us informed. We have worried about you.
