Default Questions about Missouri Casenet

I am asking because my son's bio-moms g-ma is telling me something totally different than what the court records say, and vinelink's toll free number information matches what is on casenet. I feel like she is lying to me- mostly because she has been lying to us for years and years about my son's bio-mom. I am trying to make sense of it all so that we can figure out what to tell our son. I mean there is a huge difference between getting out in MArch of 2008 and March of 2012!

Of course it may be wrong, but I would think more likely than not grandma's wrong and court records are right.

The court records say she got her probation revoked and was sentenced to 7 years, the g=ma is telling me she got 120 days to cerve concurrently with the 120 days she is now serving. Vinelink agrees with the court records so that is what I'm going with. What do you think?

Well, I'm a paralegal so I know a little bit about Casenet. I hate to say it, but I would trust what its saying. But, there is always a chance for human error. And my guess is vinelink feeds off of Casenet, so if one of them is wrong they both would be. Where is gma getting her information from?

I think that anything that has to be input by humans is subject to incorrect info once in a while. That said, I agree with Jordans Mommy here...I would be more apt to believe casenet and vinelink (that match) to a mom that is probably in denial about things.

Couldnt this be it as well?? She did get 7 yrs but that is suspended and she is doing two 120 shock days?
However, vinelink I think would tell you the full term. It does for us anyway it says 3 yrs and he is doing 120. Might be best to call the caseworker. If you know his name call the prison and ask for his caseworker and better yet if you know the number since you looked up vinelink.

Casenet is dependent upon a person entering information and as such, there is always a chance that the clerk doing so might make an error, yet, in my many years of doing legal research, I have found little wrong with the information entered. What I would suggest is that you ensure you are reading everything as sometimes an entry is made in a separate line and while it may not appear to be a Court ruling or order, it may very well be.

I kept thinking about this after I went to bed and I realized this might have also been the case. This could be what happened. Or is it possible maybe you aren't reading casenet right? Sometimes they can be pretty confusing.

Okay, I am a little confused. What is vine link telling you when you call them? If her probation was revoked then I believe that she would have to go in front of the Parole Board to get them to give her an out date.

I agree with Willow, make sure you are reading the Entire record on casenet, including the docket entries. Getting 7 years, may not be all that is said, it may be 7 years SES or SIS,

Our Clerk likes to type and type so the docket entries are practically novellas, your clerk may be different but when you get to the main screen of the case, clcik the tab that says docket entries, a new screen will come up and you dont need to enter any dates just clcik "find" (i believe thats what is there it might be "next"). Then you will see number sin blue, the higher the number the more recent the entries but you can just start at number one and read the whole thing if you want.

In regard to the actual sentence imposed, my brother received a 4 year sentense but was put into the 120 day program and subsequently given probation by the court. Hence, while his actual sentence is 4 years, the Court has discretionary authority to suspend the sentence pending an offender successfully completing the 120 day program. So yes, the person you speak about can have both sentences.

Ok, well here is what I know now. I called Morgna county myself and they said yes she got 7 years. I tlaked to her on Friday and she said this is what the judge said:
7 years DOC, then asked the PO if they had a bed date for her in the 120 treatment program and the PO said no, her lawyer said well judge I can help because she is currently in the 120 treatment from another case and is half way through. The judge said ok we will use that, and that was the end of the hearing.
I think that means he is letting her current 120 count so she doesn't have to do it again, but she is still sentenced to the 7 years- She thinks she gets out after the 120 is over.
I don't even know! I really think she is confused but only time will truly tell. So I guess I won't know anything for sure until March. What do you guys think?

I don't know but that's crazy that no one can give a definate answer. Maybe call her attorney and see what he/she says. They should definately know. Good luck and hopefully its just 120 days.

Have you checked the vinelink number? It might have an outdate.

does she have a min mandate placed on her? this would have been done at sentencing. like to serve 40%, 45% or 85? if she does, then she will not be released prior to that date, no matter if she finishes the 120 or not. she will have to do the min required on the sentence. if this is her first time, which doesn't sound like it is, then possible about a week prior to completion of the 120 vinelink will change and give her new release date. most of the time, it works this way. someone may know different.

Thanks so much for all of your help and support. I talked to the county clerk and she said that the sentence was 7 years, her lawyer won;t talk to me because I am not immediate family and I know she is waiting for a meeting with her case worker. I really feel like she is going to have to do a good chunk of the 7 years, this is not her first offense and they gave 3 violations without any real repercussions before revoking her probation- which it does say on casenet in the docket along with the 7 year sentence. I guess we will all know the real verdict when she does or doesn't get released in March. Hopefully she will figure it out and let us all know before then though.

Thanks, the hardest part will be telling my son that his mom won't be out when she thought. We are waiting though untill all of his birthday celbrations are over so it will be the middle of Feb before we tell him. We just don't want to mess up his happy birthday moments with worries about his mom. Thanks again for all of your support. It really helps a lot!
