Default Intro--halebop from California

I'm brand new to the site and to having (possibly) a loved on in prison. There is so much I don't know and it's a relief to have found this wonderful resource.

My boyfriend of 11 years is likely to be sentenced to 2 years in state prison on Thursday for drug possession charges. I say "likely" b/c I'm not sure what to expect.

His original arrest was two years ago. In that time he has gone to court as ordered every time. But he has not complied with many other requirements (namely probation). He has had many bad reports from his p.o. and many missed drug tests.

Last week he was picked up for failing to comply. He spent 1 night in jail and the judge reinstated his probation BUT the judge also said that if he screwed up again - he'd be going to prison.

Since then he missed another drug test AND was re-arrested for possession (again). He's never been in trouble before (other than possession) but I think he may really go to prison since the judge told him he would if he screwed up again and now he's missed another drug test and been arrested again in less than 2 weeks time.

Court is Thursday. I know prisons in California (and probably everywhere) are bursting at the seams...but should I be prepared that he'll likely be sent to prison?

Does anyone know if that happens - would he be allowed to go home again on Thursday and then surrender himself in a week or would they take him right from court. (he isn't in custody at the moment)

I'll try to read more and not ask too many questions - but I won't lie, I'm terrified.

Thanks for the warm welcome. I won't lie....as his court date gets closer (tomorrow) I'm not holding up nearly as well as I thought I would. I'm terrified. It is some comfort to know how many strong people have gone through this (and far worse) and gathered here to help each other.

Thanks again.

It will all be up to the judge if he will send your man right then to county or not. I have heard of after sentencing in court they have you surrender yourself by a certain time. So it is possible but again all up to what kind of mood that judge is in.
