Unhappy Probation violation/welfare fraud

July 2005 I was convicted of Felony Welfare Fraud ( for child day care). Was given probation and fines. I have now been on probation for almost 2 1/2 years and have reported faithfully every month. I met every requirement except...I have not been able to make every restitutuion payments to the state. I sent the welfare department a letter stating that I knew I was in arrears and that I would be making payments to catch up.
Last Friday I recieved a letter stating that I was in violation of probation and had to report to a DOC within 1 business day between 8-9 in the morning. So that would be this coming Monday. I am terrified. This was my first time I have ever been trouble. I don't know what to expect. I am so scared of going to jail...Please tell em what to expect and what I can do.

It will depend on how far behind you are and how long of a probation term you were given. If you're in jail, you can't make much money to pay on the restitution.
They might just be trying to put the fear into you to motivate you to catch up on payments.

What was the full restitution ammount, if you dont min sharing. I am being charged with 26 counts, all of which is an accused embezzelment/grandtheft of $207k. i got a plea, but we are waiting for better. my lawyer says the plea is crap, that people are let go on probation for things much worse, but its the counts that the DA is holding me to. so basically unless i can offer some restitution, im looking at some prison time. im searching all over this forum for hope i can cling to.

thanks! and my prayers are with you. i hope things go in your favor and you are able to continue making your restitution. because lets face it, with financial crimes, if you can be out and make restitution thats really better for everyone!
