Default have you heard of this? vicitim notified prior to release

that the victim needs to be notified that he is being released 35 days before his release date?

I have heard this. It is federal law.

Quote from the feds: "All states give victims of crime a right to be notified of the offender's escape and of any parole hearing or parole release. Most states also notify victims of other types of release or transfer"

thank you temeron, i know there is a difference between federal prison and state prison, he is at SCCC so they would notify the victim? or did he have to put somewhere on the paperwork that he wanted to be notified?

they automatically notify the victim in advance so the victim can get it settled in their minds that the person will be running around in the big world again. And if they still feel threatened they can adjust whatever they need to do. Its a safety precaution and I think its a really good idea and I would expect it if I were in a situation. Sometimes the victim has a victims adovacate that the victim can call every so often and get info on the inmate.

from what I've seen you have to put in a written request to be notified of the inmates release, otherwise it's a crapshoot if you'll get the heads up.

thank you the thing is his counselor hasn't sent out the notice yet she has 4 more days! what happens if she doesn't send out the notice will he not get released?
It almost makes me wonder if he moved to our town on the same block as the family business b/c he knew that he would be getting out-sorry i'm still kinda stuck on that issue

penwife~ should the victim have done that at court when he was sentenced? If so we never saw him as he was tried for something else

I would think that if the counselor didn't notify the vitim it is NOT your guy's responsibility and I doubt they can hold him longer for that. I do know that the state DOES normally send out a letter to the victim that he is being parolled. I am not sure that the victim has to ask for it, but it would be likely. I know that if I was a victim I would want to know. As for the guy moving onto the same block as your guys family business, I am thinking he is just doing this to be a jerk, but that is only MY opinion.

thank you temeron, my man cant notify him b/c of the NC order, and yes i do think he moved there just to be a jerk and say that he can.

well what if they can't find the victim?? hmm ...

which i hope he (the "victim") is MIA .... hahahahaha

or what if they dont live in the same county? does that matter?? do they still have to notify them??



they told my man they(DOC) are gonna give his "victim" (i call him a bitch) the notice that my man is being release .... i think thats stupid ... because i know in our case, that other fool is gonna try and cause problems ... URG !!!!!!! i swear maybe next time its gonna be me having a victim... freaking idiot.....

thank you penwife, i'm not sure if he will have the GPS device though.
Shorty i am in the same boat as you but we know where he lives. I think the prison will do everything they can to notify him and i don't think it should affect his release date.

Victim / Witness Notification Act of Washington. It has been "a few years," but here's what I remember when working with the State Probation Office: Witnesses / Victims are eligible for notification, but must put in a form with the state probation office and keep their address updated with them. Even with this, some people miss being notified. It is the Probation Officer that has the responsibility for notifying victims & witnesses that wish to be notifed. Some victims have "orders" that the "offender" cannot live within a certain range of them (feet, miles, whatever). The victim can put in a complaint about prospective "locations" for the "Offender" and they may or may not be honored. I would not think that the victim living on the same block as a family business (the key word being "business"), would effect the "offender's" proposed living arrangements. Victims are not supposed to prevent the offender from maintaining a livelihood.

So, the probation officer needs to notify those wanting to be notified. Those notified need to respond, if they have any objections. The objections need to be recorded, quantified, qualified and generally checked out by the probation office to determine validity and strength. Then a determination is made whether to honor the Victim's objections or not.

thank you DMN~ that does help! I'm not to worried about "the victim" being notified i don't really actually have another term for him since nothing happened to him...
but i think his parents are going to check on the NC Order since my fiance does frequent the business alot and i would hate for them to be on the same street and it violate the NC Order, i will update when i find more news-thanks

I don't know about the time factor but I do know that certiain crimes )sexual predators and DV the court system will notify the victims
