Default White collar fraud arrest, how does bond work?

Hi all,

I am new here but have been browsing for weeks. I will most likely be arrested soon for white collar fraud charges (many counts) and even though I have been searching diligently I have yet to find out how bond works on the federal scale.

Can someone with experience give me some information please? It would certainly help to feel better knowing what to expect going in. Do they allow you to pledge assets (houses) in lieu of cash, etc?

Any information you can provide will help a ton

There are two types of bonds, secured and unsecured. I was given a $100,000.00 unsecured bond for 1 count of Perjury, and I didn't have to put up a cent.

I believe that they will equate your bond with your potential as a flight risk(wether you will appear for trial or not).I hope this helps. Good Luck!

Does anyone else have an example of getting an unsecured bond like this?

How long from being arrested does it usually take to get back out on bond?

Thanks again so much, this time is so difficult to deal with

Chances are, you wont be arrested. You will more than likely remain free until arraignment and then be able to bond out at that time.

I was never arrested - when I was arraigned for a white collar crime I surrendered to the FBI the morning of my arraignment. I spent a couple of hours in a holding cell before my arraignment and was processed (fingerprints, questionnaires, etc.). I went into the arraignment to face a criminal complaint and the hearing lasted about 10 minutes. I was deemed a low flight risk and was released with no bond with conditions (no drug use, can't leave the state without permission, must maintain employment).

I think this is fairly common. I have strong family ties in the area. My PO checked in with me once a month or so, but it has been fairly painless.

I was arrested on white collar conspiracy charges. I was placed in a holding cell at 7:30 AM, went before the judge at 3:30 PM, and was released on a signature bond at 4:30 PM. Unless they have reason to believe you are a flight risk (or a danger to society) they will usually release you the same day. Its a real pain in the butt for them to keep you overnight if they don't have to.

If you have been working with an attorney and/or talking to the prosecutor up to this point, you will likely just be noticed of the arraignment and allowed to come in on your own and avoid the arrest; however if you have not been communicating with the prosecutor - expect an early morning knock at the door with an "unexpected ride" to jail.

My husband was arrested for conspiracy and securities fraud and had to post a $500k bond.
We put up our house. I don't know how they decide who is considered a risk and who isn't. As far as I'm concerned my husband wasn't a flight risk and I've seen lower bonds on violent criminal cases.
I would ask your lawyer.

Yes, I've seen people who were arrested for Bank Robbery in my district who got half of what I got.

My attorney said however, that it reflected the "political nature" of my case.

I was charged with one count of embezzelment a few weeks ago. I could have been charged with many counts of embezelment but we plea bargined. I was fired in march... I plead in June and was let go on no bond. I didnt even have to check in with anybody untill after I was sentenced. I have a very VERY, did i say VERY pissed off vengeful ex employer who has done everything in their power to make sure I suffer daily. They were to the point of calling the FBI agent and the Prosecuting attorney every other day with any info they heard in town.. made up or real. I have seen that every district is differnent how they handle cases.. but I know the night before I was called by the po officer to find out where my family was and because they were all here.. I am sure they considered me to not be a flight risk. I was never arrested.. but in handcuffs or anything like that. If I can be of any help, please let me know.

Political Nature...yup, that fits my husband's situation.
Last minute the prosecutor wanted to talk to my husband suggesting that they could adjust his sentence. My husband replied w/ a "No thanks.
I'll take what I've been given."

White collar crimes are the new popular thing people are getting caught and charges are being pressed but each case is different. The bond and publicicty all depend on the Judge the political arena and who you stole from. People think the reason we stole is greed. But stealing is an addiciton that has trigger points- it can be related to gambling or other issues feeling of unworthyness - materialistic society ect... Anyone who is going through this can and needs to take a hard look at why we stole and make changes in our lives to prevent it from ever occuring again.

But Not everyone stole. Sometimes the Feds just casts a wide net and just having a "bad" business connection puts you into a circumstantial situation.

Thanks so much everyone for the great replies, they help alot! As you can guess from my name "remess" my charges will stem from a real estate mess.

I have still not been indicted so no arrest or "turn yourself in" as of now.

I am meeting with my attorney today to discuss how it will go, thought I've gotten the general idea now from this thread and from reading a ton.

Thanks Lyngirl for your specific info as I am dealing with someone in the case who is quite ticked off at me too

Will update when I know more!

It all depends on the Judge and your attorney. Remember that this is not circut court it's federal. Most attorneys have ties with Judges becaue they are elected not appointed, this is something to keep in mind. My fiance spent 24 hours in jail, was given 5000.00 bond 10% so 500 to get him out. Then he had to go to the federal marshalls and turn himself in before his 1st hearing. He was released on his own recog. and was given probation until his court date which was 10/1/2008. the probation officer never gave him a drug test, never came to check our house, or anything. We got the 500.00 back and that's about all. This is the first time that he had ever been in trouble not so much as a speeding ticket. I see that your from ohio. My friends dad is a federal Judge for ohio. Do you know who your judge is? Maybe I can get some info for you. Let me Know

Have your attorney contact the AUSA prosecuting the case, and agree to have you appear for your initial appearance/arraignment/bond hearing by way of summons.

I was arrested for fraud and sat in a holding cell downtown for maybe 3 hours. I was given a $10,000 "signature bond" which meant I didn't have to put anything up, just sign and walk out. The funny part about it was the guy explained to me that if I ran I'd owe the government 10K which I think would be the least of my worries if I did.
