Small age difference (I'm underage)

Heyy ladies =)
I'm currently 17 in California and my boyfriend of almost two years is serving five months in james musick facility for violating his probation. iv been sending him letters and i talk around things but its fairly easy to see im his girlfriend. iv never directly mentioned my age and we're only a few months apartt. you dont think he will get in any kind of trouble right? thanks so much. I'm stressed about this.

If he's 18 or older, then yeah - he can get in trouble, so just be mindful of what you write and never mention your age and it should be fine. He only has a few months, so just watch what you write about.

If you are 17 and he is 18 in an adult facility YES he can get in trouble. If he is your man shouldnt he know how old you are? I have seen this go in a bad way and cost some guys YEARS in prison. My husband has a friend that is doing OBSCENE time because back when he was 19 his girl lied and said she was 18 and she wasnt and her parents slapped a stat rape charge on him. He has been in prison more than 10 years over it.

Not implying this is what is going on, but if you care about him and worry what happens to him, YOU MIGHT want to let him know your real age. I am unsure of your state laws on being a adult, but I know nowhere that I know of an adult is age 17. If you tell him your REAL age and he proceeds knowing the truth, then its on him.

It really sucks that people can get punished over this happening but it does happen. Again, NOT implying that you are doing this, but you MIGHT wanna run it by him.

Be easy girl cuz people do a lot of time behind stuff like that- i would watch what you say in his letters, and like someone else said on here, youd hate to see him do more time for sutten like that

So I am assuming you'll be turning 18 soon then? Like in a month or 2?

I can't imagine if you're only a few months apart that ANY prosecuter would file charges against him......

Yea I'm actually turning 18 next week. And we arnt sexually active he respects me beliefs. My parents love him I cant imagine them ever pressing charges even if they could. I'm sure it will be fineee

Haha...I've been through this. The cops told me that charges could only be pressed with my cooperation (at 17 1/2...no earlier) and that as long as there was no proof of sexual activity there was nothing they could do. I'm not sure how it works on the inside...but outside they basically just said "cool it" and we don't care just don't have sex.

but the police getting involved was a stress neither one of us could take...so that was the end of that.

you said it's only a few months age difference? I don't really think they care about that at all....your parents would have to say something and you would have to press charges at least on the outside

In all reality your probably fine for two reasons. First is that you are writing, you are not engaging in sexual behaviors. California law says that you are unable to consent to sex before the age of 18. Therefore, any teenagers in California having sex under the age of 18 are breaking the law. Seriously doubt that they will attempt anything there!

Second, California penal code 261.5 says

" (c) Any person who engages in an act of unlawful sexual
intercourse with a minor who is more than three years younger than
the perpetrator is guilty of either a misdemeanor or a felony, and
shall be punished by imprisonment in a county jail not exceeding one
year, or by imprisonment in the state prison. "

I work in this field, but in Oregon. It appears that California has the same statutes we have, in that there is a three year grace period. Most states have this, for the exact reason your speaking of. Boy and girl meet and date through high school, he turns 18, she is 16 . . . etc.

SO, I think your fine to continue writing. Your not engaging in sex and your less then three years apart. HOWEVER I would warn you not to write steamy letters or push the envelope too far, keep it G ok? In all reality, the CO's probably are far more interested in serious stuff then in an 18 year old getting mail from a gf. . . .
