What does hardship mean? how does that work?...

Hardship is just what the word means. Hardship is something that immigration will consider in some deportation cases and when people are trying to get a visa but have been deported or have a criminal record.
Hardship is the effects that deportation or denial of visa will have on the affected US citizens (spouse, kids, other family members) This can cover many different things. It is best to talk to an attorney to see if this would help your situation. Examples would be - the economic effect this would have on your family if he is the primary breadwinner or if someone has a medical condition and he is the primary caregiver for this person or emotional support for their caregiver. There are alot of different scenarios that can create a hardship case. Hardship alone often will not win a case, but it provides a mitigating circumstance if there is any other factors fight-worthy in the case.
