Default Custody Reduction

My husband is currently at Madison Work Camp. I am still learning the system "ropes" and would appreciate any advice as to who I could write to assist with a reduction in his custody. He has been there since the beginning of March '08 and we anticipate that with gaintime his release date should be somewhere around Aug '09. He is currently at a medium custody level and would like to be eligible for work release. Thanks.

His Classification Officer will be the one who puts in the request to reduce his custody level. I would speak to him/her to find out when he will be eligible for a reduction.

There is something that will keep him at Medium. It is a detainer. My husband had that problem at the facility level. DOC had taken care of the cancellation, but there is a screen just for the facility and it had gotten overlooked that it was cancelled and not notated there. He had a "pending" detainer. You can talk to his classification officer and maybe she will tell you. If she won't give the specifics if there is one call Ms Brooks in Tally (warrants) 850-410-4383. She was very nice and let me know the county so that I could call and find out what was going on. His classification officer got it taken care of before his custody review, which is 6 months when less than 3-5 years (?). Over 5 years is yearly, not sure when breaks with more time.

If he has an active warrant it is on the DOC website below his picture.

Thank you ladies - he seems to think I should start a letter writing campaign or write to the Governor. Honestly, I'm still very angry that he is even there and am still coping with adjusting without him. I am being a good wife and standing by him but I think there's really only just so far that I will go. I am glad to have this site resource. It looks to be a very good source of support. I'm afraid a letter writing campaign won't help much. We also don't know his charges, that could be part of the reason. If you call and talk to classification they may be able to help you find out why. If it's do to a detainer then you can get him the info the help take care of it. HE has to do it though.

Don't let him push you, I take it that he put himself there. DOC does things in there own time and all you can do is make sure that there is not a block somewhere. There is not much more you can do.

It's interesting that you make that comment that "he put himself there". Is this a common occurrence? He did 6yrs when he was 17yrs old but has not been in prison since (about 30yrs). He says that he's been going thru a mid-life crises so I've tried to be patient but I've just about had it. We've been together for 24yrs but this may be my straw. I'm trying not to spend too much time trying to figure out what's going on in his head and I'm just working on myself and getting a plan in place for when he gets out so we know where the boundaries are. He has no detainers other than the probation he'll be on when he gets out. I don't think he was prepared to have to do 85% of his 2yrs because when he was in before his sentence was 20yrs and he only served 6yrs. Thanks again.

My Husband's classification just informed him that he wont get a reduction from medium to minimum (or community for that matter) because there is some kind of point system. I dont remember the exact points but they said it's based on past crimes, time between your last incarceration, whether you had a GED, employed while you were out, blah blah blah. He did earn a lot of points for program certificates, gain time, no DRs and stuff like that but they said there's no way he can get to the point level that will bring about a reduction in his custody level.

If you go onto the FLDOC website and research custody level and follow the links it will take you to the administrative rule regarding the establishment of custody level. It will give you all of the guidelines that they have to follow. It will also give you instructions on how to write to the forms custodian for the State to get a copy of the score sheet. I just got mine and am sending a copy to my husband. He is coming up for his first custody review in September and we are hoping for minimum and/or community. By September he will have about 1yr left on his sentence so he wants to get work release and hopefully get closer to home. He is currently 5 1/2hrs away. Inmates love this kind of info. I get from talking to my husband that they basically treat them like mushrooms inside so any hard info they can get their hands on is like gold. And, it's always a good idea to be able to keep an eye on what goes on to be sure that there are no "errors" being made. I am also currently in the process of getting all of his medical records to keep an eye on what's going on there. Good luck.

my husband started at minium custody and I was told at Lawtey he has had his form sent for review and approval for community custody/work release that was last week......but then he got a strip search in the middle of the night and told he was under investigation, took his gate pass too......so I'm trying to get to the bottom of it, they didn't find a thing.....but he still hasn't got back to work

MY husband is currently at Cross City. He was classified as minimum but then seen he recieved a detainer which brought him up to medium. No one has contacted him about his detainer or his custody change so I dont know what is going on. He only has to serve 13 months (or 11 months witht he 85%).... he is matching the work release standards so I dont know what to do now. We are just trying to get him to start working so he could help more around the house and maybe get closer to home!

Contact his classification officer and ask her what the detainer is, he/she may tell you. You can also go to the DOC website where his picture is and scroll down and you will find out which county has he detainer and call the clerk of the court and find out if anything can be done. We've taken care of a detainer that way. It's better to try to take care of it now, so that they won't be there to pick him up when he's due for release. It's public info, so the clerk of the court will usually help you, even if it informing you that he needs to write a motion to a judge or tell you which judge's clerk to talk to for info. You will be able to do this part for him to speed up the process.

He can still go on to work release with the detainer, it is my understanding that the detainer is there until they are released, I've never heard of them being picked up after release for a detainer, unless they have something else pending at a nother state or other charges they have not taken care of, I could be wrong, but do let us know if you fnd out anything.

Are you all talking about the CARS custody score? I looked all over the website and did not find anything referencing a custodian for that form or any way to obtain the CARS score sheet. Can you enlighten me? Since we both are from Florida.. I would love to see my son's score sheet. Is that possible?
