Default Home Confinement

Does anyone know proceedure/policy is transfering home confinement from one state to another? I do know that the receiving state has to accept. Is there a time frame on how long it takes?

If home confinement falls under the jurisdiction of Interstate Compact like probation and parole does, the process can take anywhere from one to six months, with 90 days being about average.

Thanks Vicki. I am not sure what is interstate compact. How would I find that out. I am not sure that the Judge will even approve it. I think Chad is going to be spending a little bit of time at NCRJ before he can be taken to ACC. The bad part of this now is he is in the convicted felony section. His was for nighttime burglary. I am really having a hard time dealing with the thought of him being there for a while now.

Very worried this time.

Just keep telling yourself that if Chad buckles down he can be out of the Anthony Center in six months! Remember answer to prayer delayed is not not the same as answer to prayer denied.

Interstate Compact is the commission that transfers probation and parole from state to state through the probation and parole offices. I am really not sure if home confinement can be transferred, or if it can if Interstate Compact is who handles it.

You are a God send Vicki. I will tell Chad. Question, if indeed at the hearing that is what the judge declares and once Chad has a room there, I read something that they are in evaluations for a couple of months before they even start any program, is this true?

Yes, depending on the population, evals and classification can take about six weeks. Also, since he has done so poorly on home confinement, it is entirely possible that he will remain at the regional until bed space becomes available at ACC. As hard as that might sound, the structure may do him good and he'll adjust quicker once he gets to the Anthony Center. Last thing we want for him is to mess up again while waiting for his bed!

Thanks, you always make me feel a little better. You know so much. What other choices would there be other than staying NCRJ until a bed is ready. I have heard the wait is extremely long.

That's about it, I am afraid unless he is released on home confinement again. The wait can be as long as 6 months, but I would count minimally on 3.
