Default Need help re: immigration

Hi my friend posted this in a couple of other threads but I thought if I posted it here I could get some more feed back for her. Shes new to the site and is still learning how to work it. Thank-you

Hello everyone,

I am new to prison talk and not sure how to post. I hope this is a good way to start.

My husband has been sentenced to 1 year DOC for a DUI/Driving on a revoked. He is here in the US illegally. He has to serve 61 days. We are concerned about him being deported due to this. What are the chances he will be deported with a charge like this? Also, we are wanting to start his residency here. Will it be hard to do now with the felony DUI? Does it make it eaier since we are married? We have been married for 1.5 years, been together for 11 years, own a home, and have 2 car payments. Does any of this matter?

He is still in reception and cannot call anyone or see anyone for at least 30 days. I am so lost and confused!

If anyone has any idea, please let me know. I am seriously worried.

First let me state that I'm not an attorney or any other professional who has experience in this area. However, I'm an avid internet researcher. Judging by what I'm finding on the internet from what appear to be reliable sources (e.g., attornies), it looks like her husband will be deported BUT he will be able to apply to return to the US with a green card. He'll have to apply from his own country. There is a hardship waiver but apparently it's very difficult to get because the hardship has to be way beyond ordinary. Hardship waiver info is here:
