it sucks that they put them so far away from family when there is a facility right here in San Pedro, if he were here in San Pedro we could at least visit him and he could see his son who he hasnt been able to see in the past 2 1/2 years...we tried to put in a request for him to be moved closer to home, that was when he was in Alabama, they moved him further to Maryland instead

What difference does it make where they deport to. They are still going to send them back. So they move them to another border town and deport there same thing can happen. Heck alot of the guys they deport have been in prison so where are they going to send them? Maybe they should fix our immigration laws cause right now they are so messed up. I am just sick and tired of all this immigration stuff, its so horrible to have to know all these guys are going back and to places they haven't lived for years. Its just sad that no one can do a thing.

Our legal system as a whole is a joke, those with money can afford to pay a top notch lawyer who can negotiate aggrevated felony assault to disturbing the peace and walk away with a misdemeanor doing no actual time and with a minimal probation then a year later go back and get their client off early from probation and get the record expunged. But our guys get a public defender who don't even have the time to actually learn about all the facts sorrounding the case, encourage our people to take plea bargains that are not bargains to begin with but rather a quick way to close the case and move on to the next person to give them the same poor legal advise that they give to everyone. Including advise that ultimately get these guys deported and deprives them of any right to later attempt to come back to this country legally and if they do come back illegally, they face a lot a of time in prison.

Question Need some suggestion

Hi,
My boyfriend was deported in November, but he was trying to come back and he got caught, he is serving a 6 month term, he gets released in Sept 2010. i'm wondering if i can go with him across the border or do i have to meet him in Mexico? His charge is reentry after deportation.

He hasn't saw his baby since she was 2 weeks old !! i'm going to Mexico once he gets out, I have been never in this situation. i'm new to this immigration stuff, but i would like to know if i can meet him once he gets released or will i have to meet him at the border. He is federal prison in AZ. And does anyone know what border they will take him too.

Usually the one that is near where they are being held. Thats not always true but most of the time. You can not go with him but you can meet him once he is in Mexico. What we did is wait for the day they picked my husband up. We knew when he was to be released and found out what days they pick up. He was then taken to Fresno for processing and called me from there. He was then taken to Bakersfield and then to airport. He flew that evening to San Diego and was released into Mexico about 10 pm at night. As soon as he called I told him to get a motel room and I would be there in the morning. I drove to the border, into Mexico found parking and went to the Hotel he told me he was going to get. We had already been down there the first time he was deported and a friend and I had been many times looking for a place to live. I had money on his books so he had that to get a room with. Zunigan, do you know if it is true that they are no longer deporting them just to the boarders in Mexico but to their actual "hometown" or where they were born?

Still to the border. They only send them farther if they are from somewhere other than Mexico. They don't waste the time or have the money to send them any where else. There are bus loads everyday many times aday right at the border with tijuana. If they are from some other country they have to send them back there, Mexico only wants its own.

Hey guys! I hope all is well with everyone. We had his court date, to which he pleaded guilty and court was reset until 07/09/10. Now...the lawyer said that because ICE had started investigating my husband since he was in county jail, Aug 09, he can count all that time towards whatever sentence they give him now. HAs anyone been through that before? I just don't want to get my hopes up. THANKS!

Yes, since the time he is formally charged with a crime, they start counting the time he has served toward his sentence. At least in California they do.

When do u find out if the feds are gonna file illegal re entry charges? my husbands in state prison with an INS hold and signed a voluntary deportation a few years ago when he was in a county jail. When would we know if he's gonna have to serve federal time on top of his state time?

I think it depends if he had been previously deported. My husband was in State and had never been deported (1st arrest), so about a month before his release date, he was transfered over to a state prison near the boarder and deported on his release date. However, if he has been deported and he is serving time for a new charge, he will probably be picked up after his sentence and be tried in the District Court on federal charges for re-entry.

feds didnt pick my hubby up when he was in county...ice didnt either which was a mistake..when he went back to state for another charge ice picked up but not feds..he has been deported two times...feds got him now for illegal entry but r not counting it as a third reentry.he first was deported in 2005 from state,then again n 2008.this is his first fed offense..according to judge

Hey Marco'swife when did he find out he was being charged with federal charges? And when he was deported the first two times did they pick him up and deport him the same day?

the first two times yes...he finished state time then they picked him up a couple days later..the first time they picked him up and sent him to an ins detention center for a couple weekes the second time he was in one for a week...this time...we knew right away cuz his po turmned him in and ins did not have him,the feds did.this is his first time in fed,they gave him 37 months..he will do 32 of it.ins will pick him up 3 months before and then deport him.the imm judge will let u know how long he is deported for..there are yrs..5,10,20 or life..depending on crime.

Your husband was guilty of a Federal offense when he returned to the US after having been deported, and when the time on his present sentence is up, he should be sent back to whatever country is a citizen of. My best advice to both of you is: DON'T COME BACK!

Since he is being deported to Mexico it should be pretty quick. It might depend on where he is being held and how far from the border with Mexico. Since it is easy to deport to Mexico again I should think it will be fast. Everyone has the same advice "don't let him come back" At this time that is good advice since they are putting these guys in Federal and charging them. Good luck

Not ALL prisoners will be deported back to their homeland. I know of someone who has been out of state prison for over a year and because his country of origin is refusing his arrival - he now gets to take a monthly trip to an ICE office, sign in, and see if his country has accepted him yet.

Maybe the difference is that he is here legally...but I know for sure he is not getting deported anytime soon to his homeland.

The deportation process will be the same..why would he be deported earlier for re-entry?
After hes done with the fed time hell go thru the deportation process like every other inmate being removed.
