Is this your passport to your home country? I would think when you were entering your home country you would have needed this passpost. The exception to this is Mexico. I know that Mexico will all nationals to enter without any identification. When you were taken in custidy you would have received a paper confirming all the belonging that they obtained, if you had your passport it would have been included on this list. Or if someone sent it to the facility that you were at you would have also got paperwork stating that they had this document. If you have this document, contact the facility that you were at and inquire about your passport. If you do not have any document not sure they is much you can do. Also I have know someone that had a wedding ring and it was not returned when he was released. I don't believe he will ever get it back. As for your passport that is something that is easily replaceable.

You were supposed to get your passport back; however, there's no way to know who has it now. It could have been turned over to the immigration officials in your own country.

What country are we talking about? Were you flown back on a plane? Did U.S. agents escort you on the plane all the way to your country?

A passport is actually the property of the issuing government. You wouldn't have much luck suing for property that doesn't belong to you. Just go report it as lost or stolen and get another one.
