Question 2 Domestic Battery/3rd Offense - what classification?

My ex was just convicted of Domestic Battery, 2 charges (one against me, one against my teen child) 3rd Offense. He was sentenced to 1-5 for each, to run concurrently. His time served in ERJ counts as a year, so he'll be elligible for parole ASAP, though it's not very likely he'll get it.

He's currently in MCC, awaiting classification and whatever else they do there... what sort of classification is he likely to receive, and which WV prison will he most likely go to??

if it is 3rd offence, they are 1-5 years each. My ex had two against me, and i'd always threaten to send him back for felony if he ever hit me again. So he stopped for awhile.

He will probably go t St. Mary's, b/c HCC is housing more max. inmates. Its' been a long time since i worked there, and my mind is not as good as it once was b/c of stroke, but there is another one he may go too, so good luck. I wish you well, but you must remember, if he did it that many times, he will be like my husband and swear to god he will never do it again, but he will. Mine almost beat me to death in SC, i spent two weeks in the hospital four months in a wheelchair, he hurt my foot and i got gangreene in it and almost had my leg amputated.. I did not take him back anymore.. I am on disability now, and i do not want him to get out of prison and finish the job he started!!!! Please remember that!!!!!!!

oh what classification.. i used to work in classification and that is considered a serious crime against another, so i would say he would be classified as a three if not a four.

Thank you!! No worries about taking him back... I've heard all the promises, over & over again... the little "cycle of violence" chart the women's shelter gives out, suddenly struck home - it's so true... the "honey-moon period", walking-on-egg shells, then the violence starts all over again... I walked on A LOT of egg shells when I was with him. He's a very insecure and controlling person. I loved him dearly, but it's over... We have a 4-year old together, and an 11-month old that he's never even seen.

Going through the entire thing was without a doubt, the most difficult thing of my life. From one aspect to the other... the court system that's suppose to protect victims can often be very cruel, almost "mean", to women in that situation. They tell you to follow all these rules, then are almost hateful when you do - On one accassion, they almost treated me as though i were just "causing trouble"... I was just doing AS TOLD and following through... I certainly have a whole new outlook, and my heart goes out to anyone having to go through it. I'm glad that you got out alive!! Too many don't. One breaking pint for me, was when a women who lived near me was killed by her ex... All of my friends and co-workers thought it was me... what a wake-up call that was!

His family actually stalked me for several months, threatening to kill me (they made it well known that they didn't care whether I was pregnant, or not!). It got to the point that I couldn't go to the store alone. So, I gave up my 17-year career, sold my home, and moved 500 miles away, to a state that he "isn't allowed in" (done jail time here as a teenager). All the signs were there, why I didn't heed them, i don't know? I guess because he was so sweet & loving - looking back, it wasn't the real him. It turns out, he has a serious addiction, he lied and stole from me, my older kids, even his own family members. His family is seriously dysfunctional - they view his actions as normal/acceptable, but me standing up for myself & my children as wrong...wth??? Oh well, I am trying to NOT look back - only forward.

Anyway, I'm so-ooo sorry that you went through that, and pray that you've found a new start, with freedom, and peaceful days & nights. {{{hugz}}}

Please, Stay Safe!! Move if you have to...a home should be a happy & safe place, and if you're ex knows where you are, I'd be concerned. Mine finally found me, but I'll move again if i have to, though I'm hoping to find info on what county he was arrested in here, and actually verify that they ordered him to not return to the state - If so, then, I'll remain in this state, as a simple safety net, you know?? Feel free to write again if you want, sometimes it's good to talk to someone who truly understands.

Mine is at HCC. He discharges Halloween next year and is in the G unit as they call it, the therapeutic unit. I've not seen him for two years. The memory of that beating and me almost losing my leg b/c of gangreene and staph gives me chills. Now i have a lot of problems with my neck and head, and my foot is bad all over agan. He's going to SC when he gets out. I don't want him here... If you don't mind, i used to work in the prison system... can' you give me his name so i can think if i know him or not from there?

Yep, I sent you a private message...

Do you know if their DOC# gives any indication to the classification he may has rec'vd?? For instance, the 12345-1, does the -1 mean anything?? I see other ppl with -3, etc...
