See what i can find out they do have a duty of care to the guys in there and work safe dos fine them for the bunk bed but ppp is a privet prison and they get money for the amount of beds that have people that are in them if that makes sens? I realy hope that your lawyers can do something coz we all know something needs to be done!

Yes Bezzz something needs to be done, especially at ppp they would rather just pay out than spend the money to ensure the safety of the guys, well its going to cost them a bit soon ! There was something in the paper last week which brought a huge smile to the face of our lawyers its all ammo for our case an the cases of others we have onboard

In all the legal research I have been doing - as you do - LOL - here in NSW a guy sued them for falling out of the top of a bunk bed resulting in injury and was granted $100,000. Shortly after that, they made the rule that there had to be 15% total body impairment in line with Workers Comp rules and that an inmate had to lodge notice to the centre within 6 months of the incident advising that they were going to launch a suit against Corrective Services. So even though the statute is 3 years, they have their own clause for offenders in custody.

Quote:
"The New South Wales Government today said that it would crack down on exorbitant compensation payouts to prisoners", which, in one recent case, topped $100,000. "The Justice Minister said that he would introduce legislation early this year to make it tougher for inmates to lodge claims against the New South Wales Department of Corrective Services." They are talking the talk, but they cannot walk the walk. It is all spin over substance. The Government is quite happy to get out and beat the drum, kick the can and issue press releases, but when it comes to doing something to assist the real victims—the taxpayers of New South Wales—it will not do anything. The legislation was introduced after a payout in 1999 of $100,000 to Craig Ballard after he fell out of bed.

Wonder how it pans out in VIC given they are under different jurisdiction... will be interesting to follow Good Luck with it all!

Hey bombshell

My man has more than 15 % impairment in his shoulder which he had to have a full reconstruction, his knee and his hip. He saw a doctor after months of complaining an wasn't sent to hospital for months after that, so our case is pretty strong. And this seems to be the norm at Port Phillip. Even though things weren't lodged within 6 months there are still records to prove that he had been injured an trying to get medical help so we can still proceed under workers comp rules. There are a lot of cases like this at this prison. And our lawyers are not going to take on a case when its no win no pay but thankyou for the info
