The following table shows established maximum penalties for the indicated offenses. As used in the table, “DC” means the maximum number of days of disciplinary confinement that may be imposed and “GT” means the maximum number of days of gain time that may be taken. Any portion of either penalty may be applied.


SECTION 1 – ASSAULT, BATTERY, THREATS, AND DISRESPECT
1-3 Spoken, written, or gestured threats 30 DC + 90 GT
1-4 Disrespect to officials, employees, or other persons of constituted authority expressed by means of words, gestures, and the like 30 DC + 60 GT
1-5 Sexual battery or attempted sexual battery 60 DC + All GT
1-6 Lewd or lascivious exhibition by intentionally masturbating, intentionally exposing genitals in a lewd or lascivious manner, or intentionally committing any other sexual act in the presence of a staff member, contracted staff member or visitor 60 DC + 90 GT
1-7 Aggravated battery or attempted aggravated battery on a correctional officer 60 DC + All GT
1-8 Aggravated battery or attempted aggravated battery on staff other than correctional officer 60 DC + All GT

SECTION 3 – CONTRABAND ANY ARTICLE NOT SOLD IN THE CANTEEN, OR

9-32 In accordance with Section 944.279(1), F.S., is found by the court to have brought a frivolous or malicious suit, action, claim, proceeding orappeal in any court, or to have brought a frivolous or malicious collateral criminal proceeding or is found by the court to have knowingly or with reckless disregard for the truth brought false information or evidence before the court. 60 DC + All GT
9-33 Tampering with, defeating or depriving staff of any security device. Security devices include: locks; locking devices; electronic detection systems; personal body alarm transmitters and receivers; handheld radios; restraint devices such as handcuffs, waist chains, leg irons and handcuff covers; keys; video and audio monitoring and recording devices; security lighting; weapons; and any other device utilized to ensure the security of the institution. 60 DC + All GT
9-34 Tampering with or defeating any fire or other safety device. Safety devices include: fire, smoke, and carbon dioxide detection devices; alarm systems; fire suppression systems and devices such as fire sprinklers, fire extinguishers, and dry chemical systems; safety and emergency lighting; exit lights; evacuation route and warning placards; self-contained breathing apparatuses; personal protective equipment; first aid kits; eye wash stations; and any other device utilized to ensure the safety of the institution, staff and inmates. 60 DC + All GT
9-35 Establishes or attempts to establish a personal or business relationship with any staff member or volunteer. 60 DC + 180 GT
9-36 Gang related activities, including recruitment; organizing; display of symbols, groups, or group photos; promotion or participation. 30 DC + 60 GT
9-37 Unauthorized use of or tampering with a computer, computer peripheral device, or any other office equipment. Other office equipment includes copying machines, facsimile machines, postage meters, or any other device utilized in an office or office-like environment.60 DC + All GT

SECTION 10 – COMMUNITY RELEASE PROGRAM VIOLATIONS WORK
RELEASE, STUDY RELEASE, FURLOUGH AND VOLUNTEER SERVICE

10-1 Failure to directly and promptly proceed to and return from designated area by approved method 60 DC + 180 GT
10-2 Failure to remain within designated area of release plan 30 DC + 60 GT
10-3 Failure to return if plan terminated prior to scheduled time 30 DC + 30 GT

The problem with inmates filing most grievances is that the review standard is not the same as in a criminal trial, the burden is on the grievant ”the inmate” and inmates can’t win and administrative argument against DOC staff without irrefutable proof, and filing frivolous appeals can cost you all your gain time, and can raise your custody level.

Some of these have changed, just FYI.

We've added some charges in the 1-X section to cover a broader spectrum of lewd behavior. They all carry exactly the same penalty, the additions were made for record keeping purposes, due to the new PREA laws, and to allow individual parole boards to consider exactly the type of behavior committed (allegedly) in reaching a decision.

Basically theres 6 new charges: Lewd and lascivious on medical, security, or an inmate and then aggravated sexual on the same.

If I remember right, some of the DC and loss of GT times dropped as well for a few other charges. I'll get the exact charge numbers and terminology in a couple days and post it.

Actually, anyone can keep up with this at

But, FLco may have a more detailed list.

The specific article for Rules of Prohibited Conduct and Penalties for Infractions 33-601.314 is here https://www.flrules.org/gateway/Rule...?ID=33-601.314 Just double click on the Word doc file and open it up. There are other punishments to these infractions the ICT (Institutional Classification Team) may use, also. There's a bunch so you just have to go through each article of the Chapter and read it. The ICT is made of up several of the prisons employees, like the warden or his designee, head of classification, and maybe a colonel or someone else. Every person that gets DC time has to see the ICT upon release from DC and what ever they decide (say, they take his visits for 6 months) does NOT count the DC time. When the ICT decides any further punishment, time starts then. I hope yall can understand that, cause I just lost myself. But, it's late, so maybe FLco or TyronesWife can clarify. And, at that time, the ICT will also reassign the prisoner his 'job', and it might be different than the one before DC.

Nope...thats actually the same list we have in the dorms. Some of the rules are more enforced than others though....kinda like triage in a hospital. We pursue the more blatant violations over the more minor or 'subjective' violations generally. Some 'robocops' will enforce every minor rule they can, and though technically legit, it tends to breed alot of ill-will when you mess with someones EOS date over an empty plastic baggie (technically contraband).

The 'new' charges are 1-6 through 1-22, BTW....1-6 just separates a non-contact sexual assault from the one with contact (1-5), and reduces the GT loss. The rest replace the older charge for assault (1-1 and 1-2), and make more sub-categories for the different types and targets.

The most commonly seen charges at most institutions are, in order of popularity are: 6-1, 6-2, 1-4, 9-1, 1-6, 4-3, 2-4, and 5-2

I just read the rules. Is there anywhere that I can get a rule book? My grandson got a DR because he was found with suspected gang paraphernalia. What happened was that someone gave him his reading list of books that he was interested in. Rich looked at it and left it with his things. When he was transferring to Lancaster WC the handwritten list was found with a drawing of the Celtic Cross crossed out. This was called gang paraphernalia. The Co told him to plead guilty, but he refused because he was not guilty. He was told that when he went to the hearing, he could call witnesses. When he got there he was told that he needed to call them before the hearing. He was judged guilty partly becasue he has his girlfriend;s initials tattooed SNS for her initials. They thought it had to do with SS as in Nazi. He put in a grievance about 6 weeks ago and has heard nothing. Yesterday, his Classification Officer came up to him and told him to sign a paper. He said, "Sir , I cannot sign it until I have read it." The officer said to sign it anyway and said are you getting smart with me? He said, "No Sir," I am not. Then, the officer said he did not have to sign it anyway and gave him a copy. The copy says that he has lost visitation for a year. How can this be? Any discipline for this infraction does not include visitation. Nothing has happened to the kid who gave him the list either. Does anyone have any ideas of what can be done?

He should have received a response to the grievance weeks ago. He needs to consult with the certified law clerks in the library (if he has access where he is) and learn about his options and how the grievance procedures work to see what his remedies are. By now it might be too late (formal grievances to Tallahassee have a small window) but he needs to find out anyway. Grievances are rarely beaten. Even if the SNS is excused, it won't nullify his possession of the list. Officers don't care about explanations. On what grounds did he lose visitation? That's really an extreme but somewhere it should say what specific rule was broken that shows this as a possible punishment. He needs to talk about this with someone there who is experienced with procedures. First things first, he has to keep his nose clean and lay low while tempers cool.

OK if they found him guilty in DR court he has I believe 15 days to put an institutional grievance in, the institution has up to 30 days to respond to him saying if his grievance was approved or denied. You can call the institution and ask to speak with the Grievance Coordinator. If they deny his grievance he has 15 days to put a grievance in with Central Office and they will respond to him within 30 days as well. As far as his visitation goes, I would say you would have to speak to his classification officer regarding that, but since it seems like.... I'd call Classification in Tally. The only thing I could think of is due to the DR they took his visitation away. I not really sure but they prisons like to make up there own rules. I've learned that the hard way. Hope everything works out.

Default Loss of gaintime.

I was reading the infractions an inmate can make and the concenquences that come with it and all equal a loss of gain time. Much more gain time then an inmate can make up. Is there an inmate out there that has come home well under the 100% time frame? My son met his 85% last January and he is still in there and its August. His 100 day is Jan 8. Any ideas who I could write to have that changed? I'd like him home this year but I can wait for January if I have to.

If his 85% date was last January, he could apply to have his gain time restored but I don't know how long that takes to get an answer. He may be released at his 100% date before he receives a response. I do not some inmates who put in a request to have their lost gain time restored but they were denied.

I know the "rule" my son broke is not written in Cpt 33 anywhere and you would think that if falls under the 10-5 Deviating from or changing approved plan without permission 10 DC + 15 GT but it didn't "per-say".
My son read me the DR that was written (that got him sent back from WRC to prison), it stated "unauthorized stop while in approved route". This subject is not "covered" in Cpt 33 about having to use a restroom. When he had his hearing they are the ones who told him it. They said it is up to the individual center. They agreed there was nothing in the paperwork he signed at the center either explaining the center's expectations (they pulled all his paperwork). They did not sentence him to confinement, nor did they take away his gain time, but they are keeping him at the prison for the remainder of his sentence.

I don't know where you want to put something like this.. While it is not in Cpt 33, but going to use the restroom while on approved route, depending on the WRC, can get you sent back to prison..

thanks for the update Phil.

One change that should be there is this bending over to tie your shoe and your behind is towards a specific person.

I find that to be so offensive. Its probably a good thing I am an old lady, and not some young stud muffin with a black belt. I called out a young man on that awhile back, he kept on walking and would not come back to talk with me.

While looking down through all the laws, it dawned on me, there is not one of those laws that we dont deal with every day in one way or another. Its called respect.

Default Mailing a copy to prison

Defining trouble makes it easier to keep yourself out of trouble. Thank you so much. I am mailing a copy of this to my inmate. He has been transferred around a lot but it seems the rules and regulations are not openly shared. Does anyone know if the inmates get basically a written form of a "Welcome Wagon guide to Prison" outlining all this stuff inluding expectations and regulations or is it a one time verbal kind of thing?
