Default Should I report this violation

Hello,

I've been on probation in VA since 3/2011 until 3/2012. For 3rd felony DUI. I got a public drunk last May 2011. I've not told my po, and have done everything requested, including the 16 week drug rehab program without a hitch. My question is, should I say something about it or not? She has said, as of our meeting just yesterday, just stay out of trouble until March and I'm fine and will be off. It will be over 10 months since getting that public drunk charge when I am supposed to get off in March.

Will she find out when she goes to close my case or not? Does anybody know what system/database VA po's use to check your record?

Thanks. Here's the catch, she says nonchalantly, "you're fine, on the day you are supposed to get off, I just do a record check and send an email to close you out."

Now I'm nervous the 'record check' will show it. Opinion?

you can do your own record check in the meantime, my guess however is that it will show up...but i rlly dunno for FACT!

I'm up in the air...I mean I've proven I'm not an addict over the last 10 months, and for a public drunk?? That's not shit. On the other hand, it's been 10 months, only 2 months left and I'm done. No harm no foul.

Being from VA, knowing what I know,I am almost certain it will come up when she does a record check.

it's not a matter of proving u are or arent addicted..it's a violation no matter how it's sliced up! The only way the po is gonna see it as you thot you culd get away with it! and not get caught and it's not gonna look too good when it's found on the background check... it's why i suggested run one on yourself and see if it shows up and go from there...i think however it shulda been stated a long time ago! but that's jus me, now that you've waited so long i have no advice for that except run ur background n see if it's there!

It's a gamble, sometimes PO will err no notice the minor violation just to get the , less paper less work...

i'd be checkin my background for sure, and then go from there, it's a deff gamble for sure! And you might b right on the less paper work i dunno tho - it's risky either way and he's already waited this long so who knows! One of them where ya feel damned if u do and damned if you dont

It could be that she already knows and is testing you. I would tell the truth and be honest about it. I think that would be better than trying to figure out at the end how that could have slipped your mind... or try to say it didn't happen. Good luck to you. It would suck to go backwards.

Report it and be honest. It will come up in a record check and then you'll be on the hook for 2 violations - Condition #1 (charge) and #2 (fail to report the charge).
