Sorry you went through that. For this case, I would hope that if he is indeed convicted of a 2nd violent offense, ahfter completely disregarding probation for Agg Assault, that it would be taken quite seriously. The offense of a misdemeanor domestic may not be too serious to the court(i hope that's not the case.) But when coupled with the original sentence, plus the failure to comply, it intensifies the situation a bit.

Default update to what happens to me next

So my son had a hearing today, it was put off till march. Apparently he isnt going to have a revocation hear for probation violation but a revocation hearing for his diversion!! I am not sure what the differance is between the two but his public defender(he was appointed one today at court) said that is what is actually going on. He said he isnt up to date with his current situation yet but he will be by next week. He did seem to think it was worse than just a standard revocation hearing from what little info he did know, with that said he said ultimently its up to judge!! does anyone know the differance between the two hearings??

The judge may have only been able to extend probation on the one hearing but under the diversion revocation hearing he can take him out of the program and sentence him to time in prison under the original charges. That's what it sounds like to me.

I would like to think that they'll take him out of the diversion program and put him on probation. It isn't a a pv/revocation hearing, its a revocation of his diversion. Just guessing though. In ky, after the diversionary period the charges are expunged. With regular probation, the charges are not expungable. Still beats jail. However, I am not familiar with TN's diversion program and I'm not saying that he won't still be sentenced. I just don't know.
