John has lost his appeal. Potter County is seeking another date. From the article:
The Supreme Court Monday denied a Certiorari review for John Balentine, which means his stay of execution has been terminated.

Prosecutors have secured the third execution date in more than a decade for an Amarillo man convicted in the 1998 killings of three Amarillo teens, according to court records.

John is set to be executed on August 22. Hoping for another stay! The article is here.

So is this date actually still set? I was hoping there had been another stay, because there is no mention of that date on either Rick Halperin's page nor on the tdcj-page (which states it has been updated April 27).

Not on Rick Halperin's page, but on his email list, he did send out that message:

April 21


TEXAS----new execution date

John Balentine has been given an execution date of Aug. 22; it should be
considered serious.

Does anyone know if there is any legal action pending? Is a stay at least possible? I have not been able to learn anything about Mr. Balentine's case.

Unfortunately , Judge denies execution stay request August 10, 2012 Other courts may help...

What is the next step of appeal ? Supreme court ? I suppose that chances are very low... :-(

I've the creeping horrors when I read that ice cold legal jargon in which they made a life and death decision. It is a human life that's on the line, not some such abstract legal principles

Unfortunately,Milkyway,you are right...the U.S. Supreme Court rarely even grants certiorari these days, and rarer still finds in favour of defendants.
