Default Colorado parole board

My husband was originally sentenced to 2 yrs community corrections in 2009. After serving 669 days of that time at the HwH he was sent back to DOC on his first HwH violation and resentenced to two years DOC and 2 yrs parole with time served credit. Upon his release in April of 2011 there were 134 days of earned time that was not applied to his sentence.

We were able to get his Mittimus amended and he started to serve his parole. He violated his parole, with no new charges, on 3-26 of this year and was taken into custody. The CO parole board decided to re-instate his parole, and modify it to have him placed at a HwH on 4-20-12. We noticed that the earned time had not been applied to his sentence.

I called TimeComp and they stated that at the time we had the earned time corrected his sentence was already completed so there is nothing we can do to have that time credited to his sentence. They also stated that they have not received the mitt from the parole board hearing. At this point his MRD date is 11-24-12 but it should have been July of his time was calculated correctly in the fist place.

He's already served majority of this sentence but with Time Comp not receiving his Parole Board hearing outcome, he still has an open parole violation complaint.

TimeComp advised that once the statute states time cannot be credited to a sentence that has already been served.

In the meantime me and my husband have lost 134 days of our lives. I'm thinking about a lawyer but with our 4 children and current financial state I don't have a way of affording one.

Please help!!! Any advice that anyone could offer would be helpful!!!
