Congrats on winning the appeal!!! There's hope. Did he use an appeal attorney? Was this on the state or federal level? We are looking for a federal appeal attorney? Any suggestions? Thanks and congrats again!

Today I received notification that he won his appeal!! I am just so happy and thankful. There really is an end to this nightmare. His sentence is to be thrown out! I can't wait until he calls so that I can give him the good news.

I am soooooo glad to see some positive news. We are fighting the judicial system for doing the wrong thing also. It is an uphill battle all the way. Right now I am having to do it by myself getting a hold of organizations, media and whoever I can contact. I have not been able to find an attorney around here that can handle the case. But I promised my husband I would not stop until I got his story out there and expose what happened.

That's great news!! My husband is in the process of appealing his too. Can I ask what to expect...what happens...also can I ask hush charges and why he won? I'm just looking for hope...I'm nervous and want to have him home...
Thank you all! Still very happy about all of this. I understand now what we have been blessed with as many people don't get this kind of result with their appeal.
He had a drug trafficking charge that held a 15 year minimum mandatory sentence. The entire appeal took exactly 15 months. 15 months of hell, but now that I look back, it went by rather quickly. The case was remanded back to the lower court with directions to discharge him, so we are waiting for him to get back in front of the judge to sign off on everything and officially drop the charges. We have a court date in 1 month. I am trying to be patient, but sometimes my patience wears very thin. I can just feel his freedom at the tip of my fingers. I am at ease because they have already removed the sentence and charge from the DOC website.
My advice to those who are working on their direct appeal or any appeal for that matter....research and keep praying. Don't ever stop either one.

I wanted to say CONGRADULATIONS to you both. My husband was convicted of sales, transportation, and a gun charge. He was not in his car and the driver was the registered owner and she just got off of probation for under the influence of meth. The DA offered her a deal ( after going back and forth to court for 3 years) to drop all chargeson her to take the stand. When she took the stand she didn't point her finger at him but she didn't say it was hers. His prior was from 8 yrs before that and not the same type of crime. The judge denied the motion to drop any enhancements. There was no fingerprints and showed the receipt and
Business license for the little 122$ he had on him. They gave him 16 yrs with 80%. It's an the appeal process but the attorney says she has seen many cases like this and it's a 10% chance they will win. This really has me wondering about our justice system. I know all I can do is pray.
