Default I may be on probation soon.Can he still come home to me?

Okay PTO I have gotten into some trouble and I go to court this month. I have no idea what is going to happen when I go because the judge of the town I am from I hear is a real a** hole. I have heard that there is a good chance I will get two years probation. My man and I have been discussing this whole issue he told me the other day that if I get probation I won't be able to visit him. Is that true? What about when he is released? I know felons aren't supposed to be around other felons but what if I am on probatin will he be able to come home to me?

You won't be able to go see him until a year AFTER you are off probation.

Other than that I have no idea.

Idk what to do at this point..I lost my job and can't afford to drive the 2 an a half hours to go see him and he comes home in six months and I am at such a low point in life and I know I am dragging him down with me..and its killing me

Its up to probation if you may visit. Chances are NO. If there's no kids, no marriage, they probably won't allow him to come hom to you. This is what I've seen with others, idk the law where you reside

Whether or not you'll be allowed to visit, whether or not he can parole to your home is dependant on other factors and varies state to state.

I was on probation, denied visits, got a letter from my PO gving me his permission to visit and included it in a letter to the Warden. Visits were then approved. My Mr was allowed to parole home due to my being on his PSI as his girlfriend and the fact that we shared an address and had a relationship before his charges. However, we were both told it was our last chance and that the only felons we could associate with were each other.

Like I said though, every state, every situation is different....but there is Hope. Good luck!

It all depends on the jurisdiction. Where there is a pre-existing relationship, it becomes more likely. However, some jurisdictions still just use the catch-all of no association with known felons, knowing that most persons on supervision won't have the money to litigate the issue...contrast that with Texas where the Board has to specifically name the person you are not to have contact with while on parole supervision.

Oh, and as an aside...when a matter is pending before a court, it is not wise to be on the internet describe the judge as a real a-hole...court personnel do scour the web for information on persons with cases pending in that jurisdiction. Inflammatory comments do not bode well for the sentence if they are linked back to you...

he wont be on parole he is EOSing his time out so maybe that wont keep him from being with me and i wont have a felony

If he won't be on parole, it will be all up to your probation officer if, in fact, you do get put on probation. Check your restrictions to find out if it will even be a problem, and work with your PO to get permission if it is. I don't know, but since you will be on misdemeanor probation, it could be a non issue. Good luck.
