Question Chance of avoiding immigration holds???

I just have a question. My fiance was charged with felony B and D, enterprise corruption and identity theft and was sentenced to 2-6 years. We were hoping that after being sentenced, he'll be accepted into the shock program at Lakeview while waiting in Ulster. He was accepted and is now in a platoon, which they say starts the 6 month countdown. I just wanted to know if this program will in any way be able to help his case if immigration puts a hold on him. We haven't gotten any letters yet but we heard that if you are sentenced with more than a year, exactly more than 365 days, immigration holds you. He has no records except for this which happened last year. this is his first imprisonment and felony charges. Has anyone of you ever heard of this or been through the same? Any help and advice would be appreciated. Thanks.

There are no strict rules on having an immigration hold. I have seen that don't have a hold in county jails, but once they get sentenced to prison (like you said for more than one year) then they will place a hold in prison, and once released they will take him. Identity theft is considered a aggravated felony, so he would have a lifetime ban on ever coming back.
