Default U.S. Supreme Court strikes down juvenile life sentences

The U.S. Supreme Court by a 5-4 vote this morning struck down life without parole sentences for juveniles, a ruling that will impact Michigan more than almost any other state.

I would like to know. How will this impact jueveniles that were sentence that are now adultsm for instance my cousin was sentence to life with out parolehes been in for 16 years. If you can help me understand this it will be great. We are in California

As I said in the other thread, this ruling apparently only affects convicts who were convicted as juveniles where LWOP was mandatory for their crimes.

As I don't believe LWOP is mandatory in California, it wouldn't affect your cousin. But soon hopefully... as new research from neuroscience proves that the human brain isn't fully developed until early 20's, it really should be considered cruel and unusual punishment to hold juveniles to the same accountability as adults.

Just came across this article online yesterday! How wonderful. Maybe more states will now follow in the footsteps and look how many juveniles we have in this country sentenced to lwop.

Truley a step in the right direction.

In california they do Defacto Sentencing which means that they senctence LWOP but with a number. Many lifers in california have 60-100 years in prison which is in turn a LWOP Defacto senctencing. If your cousin was a juvenile and he was sentence to excessive years in prison he would have a chance to have his case reviewed.

I have to correct this the brain isnt fully developed until the LATE 20's

My cousion wasn't given a number like 25 to life he was sentence to life without parole if there was a number give with his sentence at least it would give some hope. I'm also trying ow to get a copy of the transcript of his case paper work has been lost due to moving so much
