My fiance us in the Hamilton Unit in Bryan Texas and I got the fown from county clerk and mailed it to, him second week of January 2012 and still nothing. He had to go to the Law Library and they take it from there and they say it could take anywhere from 3 days to 4 months to get it cleared and notirized. Tomorrow is March 2012 and we are still waiting to get the form back notirzed.

Is there a county in Texas that doesn't require the absentee form to be notarized?

Thanks in advance!

Galveston County. I got married there and we didn't need anything notorized at all. My proxy did not have to go with me to get the license either.

The regular form has it but the TDCJ form doesn't need it.

My fiance is incarcerated at Hughes Unit in Gatesville.. He's already sent me the proxy papers and I even have a power of attorney all notarized.. But the courthouse in Williamson county is telling me I need his ID.. He sent me a copy of his TDCJ ID and now they won't accept copies.. How am I supposed to get his ID when he's locked up? I know people get married in prison everyday.. this can't be impossible but somehow I am feeling like it's me against the world! HELP!!

With the power of attorney you can order a certified copy of his birth certificate. That's what I did and they accepted it here in Travis county where I reside. Good luck.

Well, I found out today that Williamson County DOES NOT take birth certificates as a form of ID.. They should realize how hard it is for someone to get that type of thing when everything was surrendered when he got locked up..Unless you have access to his property prior to the arrest but that wasn't the case for me... I met him after he got locked up.. But anyway, I took your advice and called Travis County.. they'll do it! So I'm on my way tomorrow!! Thanks again for the response!

After some ordeal I got someone in the prison to let me talk to the law library where I learned Texas doesn't permit inmates to notarize anything. No one could say why, or what was the object of such an asanine rule. I had to return to the courthouse where a clerk there told me they had two kinds of proxy statements --- one requiring a notary and the one that did not. Why would anyone have two kinds? I obtained the new proxy statement, sent it to my wife and she signed and returned it. The wedding was performed in Montgomery County (Conroe) but the JP clerk said we couldn't do it because the Bexar County clerk had failed to inscribe the volume and page number on the license that would say where the license was recorded in the clerk's office. A difficult long distance call fixed the problem. The JP signed the certificate and gave it to me. The prison would not accept it for purposes of contact visits because it didn't look official enough. I then had to send my wife our original license provided by the Bexar County clerk. Then the prison said they would not return it to me; they planned to keep it until my wife was paroled. After some whining and begging, my wife got them to send it back to me. Texas does everything it can to make miserable not only the lives of inmates but family as well. I am a sixth generation Texan and was once very proud to be. The way our state government maintains its prison system now makes me deeply ashamed.
Well my husband got his proxy papers notarized in huntsville (estelle unit) no problem at all i have to say i didn't have any trouble at all with our marriage by proxy and they even accepted the duplicate copy and i got ours done here in kansas, sorry to hear that you had so much trouble.
