Default How long to print the certificate & what about warrant from another county?

My husband got approved on a FI-1 and we are so happy but how long does it take to get the certificate printed, he also has a warrant in a small county 6 hours away from where he is at but I called the parole officer at the unit he is in and they said he has no detainers, I was wondering if he will make it home and what happens afterwards. One more question I also wanted to know that he just got the vote last Friday and they called the house for the parole plan yesterday so does that mean the process is speeding up ,.please help!!!

If there is not a detainer lodged, then one needs to be EXTREMELY wary of making calls to ANY TDCJ/BPP office and making mention of it...a detainer at THIS point will result in the file going back to the Board and the vote likely being rescinded based upon new information.

To the primary question, I have seen people get proc'ed inside of two weeks from the date of an FI-1 being recorded and I have seen some that took longer- one case I have been tracking took right at five weeks for the proc to issue. That case included an Exception on the County of Residence for the release, so that added a week or two to the process since there were two mid-week holidays between the vote and the certificate.

The last couple of FI-1's tended to be about 10 days from the release plan being approved to the proc printing and another week to a date appearing on the online locator.

Glad yours is going alot faster, we got FI1 on the 3rd and according to release and review they barely got the file today and so I haven't even got a parole verification call yet. Grrrr.......

Anyways, congrats on your FI1!!! I'd listen to CenTex, most definitely knows what's going on in the TX system!!

Thank, well today I called the status line and they issued the certificate yesterday and it makes me happy now they said all we have to wait is for the release date but I wonder if his parole eligibility date is july 26 do you guys think he might be out by then since everything is going by fast... I am so nervous..

If he was proc'ed yesterday, then I would expect to see a date on the computer somewhere around the end of next week or early the following week. The release cannot, by law, occur any earlier than July 26 if that is the calculated PED. However, a release early in the first week of August is certainly not out of the realm of reason...

So i called the parole status line today in the morning and apparently there was still no release date and i was like okay its to early but i just checked the website today out of work and it is giving us a release date of 07/26/12 and release type "parole" and release location Huntsville ,..... So is it good to rejoice and sigh in relief...?

That's correct. My husband had a detainer, I called the city where they details was and he got time served for this... the TDCJ online system was updated from "parole to detainer" to parole. Congrats!

I guess I can see it but it is hard for me to believe it, we have been waiting for this dayto come for three years, all this detainer, warrants are confusing me, I wonder if I should call the county and find out if the warrant is gone?

If it were me, I would call the county the detainer is in, if the charge is less or equal to what your man is in for then you can get time served for things so it may make more sense to do so since you cannot get that if you are out of TDCJ, I think you all will have to go through the whole process again if he gets out and deals with with..... you never know maybe they already dropped the charge. I hear you on the confusing part... my Husband got three years and did 20 months - hes getting out on Friday and will do the rest of the time on Parole. Good Luck!!

He is doing time for agg robbery and got six years but now they gave him parole after three years but apparently he has a warrant for an FTA which is failure to appear for a possesion of a weapon by a felon, I dont know what to do, is this charge less than the one he went to prison for and should I call, I dont want him to throw this against me and say why did you call them and let them know, he had told me if they get him then we are going to hire a lawyer to fight this in the world, I am totally confused and stressed, I dont know what to do

If there isn't a detainer, then DO NOT (IMO) make calls to ANY agencies right now. Wait until he is out. Even if he goes back in temporarily until he can bond out again, the new sentence (if any) is NOT a basis upon which a revocation of parole can occur. There is caselaw that deals with the issue of prior offenses.

Contrast that with calling around and making inquiries, which will likely result in a detainer issuing and being lodged with TDCJ...after which the file WILL return to the Board for a reconsideration of the current favorable vote.

This charge didn't just sneak up on him though...he KNEW it was out there. He should not have waited until now to begin looking at addressing it. The time to have dealt with it was when he first got to TDCJ and, at a minimum, would have had the detainer in place at that time to ensure he was getting credit for the time currently spent in custody. By having waited, it is up to the DA's good nature to award credit for the time in TDCJ.

Okay, thanks, we thought this was taken care of when he went to court and had the other charges run concurrent with this charge which was obiously worst than the others but I guess we will have to deal with it all over again, the only thing that I dont understand is why were the other ones taken care of and dealt with and not this one but its to late now, we have to go through all this crap again, that is what pisses me off because that was the whole reason we hired a lawyer in the first place, I just feel like we got %$#$%#%,,... you know....
