Default Immigration to the USA

Has anyone successfully filed an I-130 or K1 visa and moved to the USA? I am in the midst of doing research on this subject but I wanted to know if anyone has had any luck or an immigration lawyer that they would recommend.

edit: I should add that I am going to be filing the I-130 next month and starting the process. I have a co-sponsor and the will to succeed so we'll see how this all goes. My concens are can a prisoner petition for a foreign spouse for immigration... Best way to prove bonefide relationship in this case.. and any specific problems which may occur?

Hi Jenilynn, I have read numerous forums where individuals have successfully filed the I-130. One of the important pieces of evidence that's needed is proof that your relationship/marriage is bonafide. This is somewhat difficult when your loved one is incarcerated. Joint bank accounts, affidavits from third parties, photo's..anything that proves that your relationship is the real thing. Me and my husband have just filed the I-130 so we wait in anticipation. I have been told it can take nine months

I am a div.....Lol....I totally forgot that one of my British friends successfully filed the I-130 Alien Petition, and she's been living in America for four years now. The only difference being is that her husband was in the airforce, although she did have a criminal record and she was approved. So there's hope for all who are wishing to leave dreary old england for the U.S

I am from the UK and have been through the I-130 etc etc. I now live in Nevada, my husband is still in prison and I was recently given my 10 year Permanant Residence card. If you need any info then PM me with your email address and questions and I will do my best to answer them.

Hi everyone I'm in the process of the K1 visa process

I also have heard of several people being successfully able to move over while their partner is still in jail

Several hurdles to keep in mind:

-if they don't make 125% above the minimum wage (it's around $18,900) you will need a co-sponsor. The sponsor will have to make that amount however if they have children or additional people living in their househould the amount they need to make increases

-certain criminal convictions may disqaulify some people for petitioning causing their application to be denied (research 'Adam Walsh Act' and IMBRA laws for further clarification). From my understanding the spousal visa is not affected by the record but I could be wrong


Also once you move over there is your boyfriend in a jail that allows marriages? As a condition of the fiance visa is once you move over to America you have 90 days to get married otherwise you have to leave.

Also you are not allowed to work as soon as you get over their if you are on the fiance visa (the spousal visa is different though) as you have to apply for an adjustment of status and then apply for the green card. I have seen this take from 2-3 months so just be aware that you wouldnt be able to work straight away
