The only way it will happen is if there is either a basis to successfully appeal the jury verdict or otherwise unwind the plea agreement.

Presuming that this was a Texas case (given your location, that is what I am basing this response upon), there have been some instances where the appellate courts have unwound a plea if there was erroneous information given by either the Court or trial counsel on the consequences of the plea as they related to parole eligiibility. Surprisingly, there are still a lot of attorneys who fail to recognize that a DFZ enhancement means an automatic five-year minimum before becoming eligible for parole...
