Default How many extensions on appeal in NJ?

Does anyone know how many extensions the prosecutor can get to reply to the appeal brief in New Jersey? He's already gotten 3 and has just asked for another! We won the first appeal, went back to trial, found out they destroyed all of the evidence, was not allowed to bring it up but they could testify to it!, and was convicted. Obviously we are now appealing this verdict but they keep asking for freakin extensions! This is all soooooooo frustrating!

They can usually get as many extensions as necessary to do the job properly. Yeah, how vague is that? Unless there are unusual circumstances, the judges will get pissed before too long. One's pretty axiomatic. Two is pretty normal. Three's really beginning to push it. That said, if the issue on appeal is in a higher court in another case, the lower court will give a mess of extensions while the higher court makes up its mind. It'd really suck if the lower court ruled against you, and the next day a higher court rules on another case in a way where the lower court would rule for you. You're stuck going to the next court up, and starting over there.

Make any sense?

How can destroying all the evidence, go AGAINST you, and not affect the prosecution? You couldn't bring this evidence up, but THEY could testify TO it? I am sick to death of this stupid logic! Whatever happened to justice, and the American way?

Totally. They asked, we disagreed and they submitted their stupid (seriously) answer. Now to hurry up and wait for oral arguments. That'll probably take AT LEAST six months to schedule. Grrrr. This sucks big time!!!
