Default Husband is my co-defendant: Can they refuse to let him live (IC) with me?

My husband is my co-defendant on a mail fraud case. He stayed with my son in Texas. I was given home confinement due to COVID-19, and returned to my mother's house in South Carolina. He has put in to transfer here with me. His PO just sent an email asking him about people in the house with criminal records. There is just my mother, who has none and me, with the same charge as he has. We have been married for 39 years. Can they refuse to let him live with me?

Hi titus2woman, I believe technically they can refuse his Home Placement with you. State DOC's can, but seldom denies home placement between husband & wife. Others more familiar with BOP will either confirm or reject my best guess. Good luck to you both!

If the PO gives him a problem (and supposed both TX and SC offices have to agree), he can petition the judge to approve the transfer. Depending on how much time he has left on his term, he can also use this as an opportunity to get off SR early.

My husband had to return to Texas while they processed his transfer. His probation officer did a video tour of the house with me. He inquired about how much longer I would be on home confinement. He was very congenial. He processed the paperwork that afternoon and my husband is approved to live here now. Praise God!

He is here and at my beck and call to run errands while I am locked down per BOP orders. I do get to go out to physical therapy three times a week. LOL!!
