Default Three months STILL in reception!!!!

I just don't understand our prison system here in New York State. My husband has been in reception on Downstate for THREE months now awaiting a bed in the DWI offender program in Gowanda. The progam is 6 to 9 months and he could already have done THREE months in that program. Instead he sits in a reception prison doing NOTHING. This is rehabilitation??? The man wants to be in a program. He belongs in a program and because there isn't a bed; he is being penalized?? He had enough county time and state time in for an initial hearing in February which of course he was denied parole...reason being "in transit unit". That is NOT his fault. That is NYS fault. He now is parole immediately eligible. I thought that basically meant he would be eligible for parole immediately but I have been told that NO because he still is not in a program. It is all so aggravating to me. You put someone in a prison to receive some type of rehabilitation. A whole year wasted and still no program. Makes no kind of sense.

Default their thinking is

that he will serve 2/3rds of his sentence (as most DWIs do)-so he is not in their eyes behind. That is a long time in Downstate-but I have read of others waiting on beds at Gowanda.

Rehabilitation is only one of three prongs to the penal sentencing scheme. Punishment and reparation are the other two.

While I can understand the OP's frustration at her loved one being held in reception for so long awaiting a bed opening at Gowanda, I think inappropriate is to "fault" DOC for such. In NY, inmates are very fortunate to have rehabilitative programs being made available to them. In other states, particularly most southern states, rehabilitative programming is but a mirage ... wishful thinking.

Is this also true about someone being in county for months waiting to be sent to state? My son has been waiting for months. He has also never talked one-on-one with his court appointed lawyer. He was convicted for DWI. He sees the lawyer when he goes to court - twice it was someone who was "filling in" for his attorney and told him they weren't familiar with the case. I have tried to call the lawyer. She doesn't return my calls. I have called and left messages for my son and told them that he wanted to see or talk to his lawyer and no one has contacted him.

My son took the option of drug court when he was first arrested (no council but what other inmates told him.) He has been in for nine months now in county. He was sentenced to 1 1/3 - 4 years. If he had just pled guilty to DWI and done the time, he believes he would be out now but had no one to advise him of those options.

I understand I am only hearing this from my son but it doesn't seem fair to me. I also understand that a court appointed attorney is overworked. I wish I could affort to get him an attorney that could advise him and actually cared what happened to him.

I DO believe he needs to pay for risking other people's lives. I get that. I just think that being uninformed should not be part of the punishment.

I just caught a little blurb on the news yesterday about inmates not seeing attorneys and waiting in jail for long periods of time without being transferred. Does anyone know more about that?

Default just understand with

1 1/2 to 4 sentence, he would usually be in for at least 2 years. So he has not served more than he would have otherwise. Also, his time in county will count toward what he is sentenced to in the end. He will likely go to Gowanda if he gets more than a year long sentence.
