Default WRDCC parole hearing

My boyfriend is in WRDCC, Western Reception Diagnostic in St Jo. This is his 1st time in trouble, he was sentenced to 2 yrs. He has done 9 months time collectively on this case up to this point which the court counted as time served. This originally started as probation , he violated several times in a short period of time, he then surrendered the probation and got the 2 yr sentence, 9 months served. The attorney assured us it would be a revolving door with him getting out from diagnostics. He has been in diagnostics for 3 weeks now and I called the probation office there at the institution and was told his parole hearing would be in November. That is more time than we had expected, we thought he would have maybe one week left. Is this normal? Is there anything I can do to speed it up ? I cant afford the attorney to go represent him, would the attorney be able to get him out quicker? His crime was possession of a Vicodin that wasnt prescribed to him , made mistake and used public defender who didnt have charge reduced, class C felony. This has been a major hold back on a promising future,.

Unfortunately there is nothing you or he can do at this point in time except ride out the time and go through the process.

When he surrendered his probation and took the 2 years, he now has to go through the motions and potentially expect to do some time if not all of that 2 years.

Once you are assigned to the Reception and Diagnostic Unit he will have to go through the orientation, medical, and classification process. You cannot have a parole hearing in the Missouri DOC until you have been through classification. Once an offender has been assigned a parole hearing, they will receive formal notification of the date and time of the hearing.

Depending on the charge, he has the right to waive formal appearance at the hearing or the board may require him to appear a the hearing. Once the hearing has been concluded the Board of Probation and Parole has up to 6-8 weeks to return a decision regarding his parole.

Missouri is a no remand state meaning that there is no minimum requirement of time he has to do on his current charge but there is a maximum release requirement in the state of Missouri.

They call is a Conditional Release date or CR date. In Missouri an offender can be held in the Department of Corrections until they have completed 66% of their required mandatory sentence.

That means your boyfriend on his 2 year charge could be doing 1 year and 5 months before they parole him.
