Default Sheriff indicted in GA for mass search

http://www.ajc.com/news/breaking-new...trFzY1bQoLHUJ/

Quote:
A south Georgia grand jury indicted Worth County Sheriff Jeff Hobby on Tuesday for sexual battery, false imprisonment and violation of oath of office after he ordered a school-wide search of hundreds of high school students. Deputies allegedly touched girls vaginas and breasts and groped boys in their groin area during the search at the Worth County High School April 14.

It will be interesting to see how the governor responds. I don't know what the case law is for full school strip searches, but to go to this extreme and not turn up any drugs will likely give the governor the political cover to take action against the sheriff like the ajc article suggests.

There are likely more drugs in this county's jail than the high school that was searched.

Forcible touching, requiring them to lift their clothing in front of others, and since the word "invasive' was used, I'm wondering about cavity searches.

It's not what you do to 900 high school kids, not without warrants, a serious trail of information leading to a particular 1 or two or 10 kids, and minimal results. And then, you leave EVERYBODY ELSE out of it.

Dumb twit, that sheriff. Wonder if he was pushing for reelection.

Having grown up in a small Georgia town with a high school this size, I can’t even image how bad the blow back would be from doing this. Rich/poor, black/white parents these days would freak out even more than 20+ years ago. When did common sense leave the building?

I went to high school in the deep south. All I can say is good luck and god bless because they don't care who or what you are if drugs are involved. And most of these people were probably caught up in stuff. Sorry not feeling anything for all involved. I would have loved to sue over bullshit too when my parents were outraged!!!! LOL

If something is suspicious then search those kids.

What a lesson we are teaching our kids. Basically, you have no rights if law enforcement wants to do something.

Allegedly the deputies were groping breasts and genitals. If there was even a single lewd remark to suggest they were enjoying themselves then it's arguably for sexual gratification. Unwanted touch in the swimsuit region for sexual arousal? I think that's the definition.

Here is the 2016 GA code for sexual battery.
GA Code § 16-6-22.1 (2016) (a) For the purposes of this Code section, the term "intimate parts" means the primary genital area, anus, groin, inner thighs, or buttocks of a male or female and the breasts of a female.
(b) A person commits the offense of sexual battery when he or she intentionally makes physical contact with the intimate parts of the body of another person without the consent of that person.
(c) Except as otherwise provided in this Code section, a person convicted of the offense of sexual battery shall be punished as for a misdemeanor of a high and aggravated nature.
(d) A person convicted of the offense of sexual battery against any child under the age of 16 years shall be guilty of a felony and, upon conviction thereof, shall be punished by imprisonment for not less than one nor more than five years.

Here's a followup. If the judge approves the settlement deal, Mr. Hobby will have cost Worth County three million dollars.

https://www.washingtonpost.com/news/...ed-settlement/

Quote:
Tommy Coleman, a lawyer for the school district, said in June that the students’ account of the search was accurate, as The Washington Post reported. The sheriff ‘s office also said in a news release after the search that “one of the deputies” had conducted a pat down of some students “that was more intrusive than instructed by the Sheriff.”

I hope the sheriff & some of his officers get a chance to "enjoy" the "hospitality" of Georgia incarceration & see how they like pat downs. We have to change the mindset that because there's a badge on a body, everything they say & do is right. This attitude of guilty til proven innocent is just wrong.

Who to believe? The sheriff “one of the deputies had conducted a pat down of some students“ or the newspaper report "Body searches of 900 Georgia students by sheriff’s office leads to $3 million settlement".

The only way to get the sheriff's attention is if those responsible got to spend some serious time in their own jail instead of only receiving the non-punishment of paying someone else's money, the taxpayer's, to the victims.

By the way, this sheriff didn't even have to wait for the president's pardon.
